64 AN ACT
75 relating to funding for certain apprenticeship training programs.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Sections 133.002(b), (f), and (g), Education
108 Code, are amended to read as follows:
119 (b) A program may be conducted by an independent
1210 apprenticeship committee or may [must] be sponsored by a public
1311 school district or a state postsecondary institution pursuant to a
1412 contract between the district or institution and an apprenticeship
1513 committee.
1614 (f) Funding for a program sponsored by a public school
1715 district or state postsecondary institution, in addition to any
1816 other money available, shall be provided by the apprenticeship
1917 committee pursuant to the terms of the contract referred to in
2018 Subsection (b).
2119 (g) An apprenticeship training program must provide
2220 [Pursuant to the terms of the contract referred to in Subsection
2321 (b),] adequate facilities, personnel, and resources to effectively
2422 administer the [apprenticeship training] program in a manner
2523 consistent with the public's need for skilled craftsmen and the
2624 apprentices' need for marketable skills in apprenticible
2725 occupations [must be provided].
2826 SECTION 2. Sections 133.005(a) and (b), Education Code, are
2927 amended to read as follows:
3028 (a) The commission shall maintain a clear audit trail of all
3129 funds appropriated for the apprenticeship system of adult career
3230 and technology education. For each course that is funded, the audit
3331 trail shall include the following records:
3432 (1) the name of the sponsoring public school district
3533 or state postsecondary institution or of the apprenticeship
3634 committee offering the course if the apprenticeship training
3735 program is not sponsored by a public school district or state
3836 postsecondary institution;
3937 (2) the name of the instructor;
4038 (3) the number of students enrolled;
4139 (4) the place and schedule of class meetings; and
4240 (5) certification by the bureau for preparatory and
4341 related instruction courses that the students enrolled were
4442 registered apprentices.
4543 (b) A public school district, [Public school districts or]
4644 state postsecondary institution, or apprenticeship committee
4745 operating an apprenticeship training program not sponsored by a
4846 public school district or state postsecondary institution that
4947 receives [institutions receiving] funds shall maintain a clear
5048 audit trail which shall include records of receipts for all
5149 expenditures relating solely to each particular course. Where an
5250 expense is shared by two or more courses, the allocation to that
5351 expense from the funds for a particular course shall be supported by
5452 a formula based on the comparative benefit derived by each course
5553 from the expense. No charges for the depreciation of facilities or
5654 the retirement of indebtedness shall be allocated to an
5755 apprenticeship course.
5856 SECTION 3. Section 133.006(e), Education Code, is amended
5957 to read as follows:
6058 (e) No funds shall be distributed to a public school
6159 district, [or] state postsecondary institution, or apprenticeship
6260 committee until the district, [or] institution, or committee has
6361 filed all reports required by this chapter and by the commission.
6462 SECTION 4. This Act takes effect September 1, 2017.
