| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter A, Chapter 372, Transportation Code, | |
| 11 | 11 | is amended by adding Section 372.002 to read as follows: | |
| 12 | 12 | Sec. 372.002. ACCOMMODATION OF MASS TRANSIT FACILITIES AND | |
| 13 | 13 | VEHICLES. The governing body of a toll project entity may not adopt | |
| 14 | 14 | a plan for the construction of a toll project unless the plan | |
| 15 | 15 | includes measures for the toll project to accommodate | |
| 16 | 16 | high-occupancy vehicles of mass transit agencies, including buses | |
| 17 | 17 | and carpool and vanpool vehicles. Accommodations under this section | |
| 18 | 18 | must include: | |
| 19 | 19 | (1) land, capital funding, and operating costs for the | |
| 20 | 20 | construction and operation of park and ride facilities; and | |
| 21 | 21 | (2) the free use of the project by mass transit | |
| 22 | 22 | high-occupancy vehicles. | |
| 23 | 23 | SECTION 2. The change in law made by this Act applies only | |
| 24 | 24 | to a toll project for which an initial plan is adopted on or after | |
| 25 | 25 | September 1, 2017. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2017. |
