A BILL TO BE ENTITLED
AN ACT
relating to toll project accommodation of high-occupancy mass
transit facilities and vehicles.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 372, Transportation Code,
is amended by adding Section 372.002 to read as follows:
Sec. 372.002. ACCOMMODATION OF MASS TRANSIT FACILITIES AND
VEHICLES. The governing body of a toll project entity may not adopt
a plan for the construction of a toll project unless the plan
includes measures for the toll project to accommodate
high-occupancy vehicles of mass transit agencies, including buses
and carpool and vanpool vehicles. Accommodations under this section
must include:
(1) land, capital funding, and operating costs for the
construction and operation of park and ride facilities; and
(2) the free use of the project by mass transit
high-occupancy vehicles.
SECTION 2. The change in law made by this Act applies only
to a toll project for which an initial plan is adopted on or after
September 1, 2017.
SECTION 3. This Act takes effect September 1, 2017.
