5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to provision of certain preventive health care services to
8	8	certain health benefit plan and health maintenance organization
9	9	enrollees.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter I, Chapter 843, Insurance Code, is
12	12	amended by adding Section 843.324 to read as follows:
13	13	Sec. 843.324. CONTRACT PROVISION RELATING TO PREVENTIVE
14	14	HEALTH CARE SERVICES. A contract between a health maintenance
15	15	organization and a physician or provider requiring the physician or
16	16	provider to provide preventive health care services to enrollees
17	17	must require the physician or provider to provide covered
18	18	preventive health care services to an enrollee not later than the
19	19	30th day after the date the enrollee requests an appointment with
20	20	the physician or provider for the preventive health care services.
21	21	SECTION 2. Subchapter B, Chapter 1301, Insurance Code, is
22	22	amended by adding Section 1301.070 to read as follows:
23	23	Sec. 1301.070. CONTRACT PROVISION RELATING TO PREVENTIVE
24	24	HEALTH CARE SERVICES. A preferred provider contract requiring the
25	25	preferred provider to provide preventive health care services to
26	26	insureds must require the preferred provider to provide covered
27	27	preventive health care services to an insured not later than the
28	28	30th day after the date the insured requests an appointment with the
29	29	preferred provider for the preventive health care services.
30	30	SECTION 3. Sections 843.324 and 1301.070, Insurance Code,
31	31	as added by this Act, apply only to a contract entered into or
32	32	renewed on or after January 1, 2018.
33	33	SECTION 4. This Act takes effect September 1, 2017.
