66 AN ACT
77 relating to provision of certain preventive health care services to
88 certain health benefit plan and health maintenance organization
99 enrollees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter I, Chapter 843, Insurance Code, is
1212 amended by adding Section 843.324 to read as follows:
1313 Sec. 843.324. CONTRACT PROVISION RELATING TO PREVENTIVE
1414 HEALTH CARE SERVICES. A contract between a health maintenance
1515 organization and a physician or provider requiring the physician or
1616 provider to provide preventive health care services to enrollees
1717 must require the physician or provider to provide covered
1818 preventive health care services to an enrollee not later than the
1919 30th day after the date the enrollee requests an appointment with
2020 the physician or provider for the preventive health care services.
2121 SECTION 2. Subchapter B, Chapter 1301, Insurance Code, is
2222 amended by adding Section 1301.070 to read as follows:
2323 Sec. 1301.070. CONTRACT PROVISION RELATING TO PREVENTIVE
2424 HEALTH CARE SERVICES. A preferred provider contract requiring the
2525 preferred provider to provide preventive health care services to
2626 insureds must require the preferred provider to provide covered
2727 preventive health care services to an insured not later than the
2828 30th day after the date the insured requests an appointment with the
2929 preferred provider for the preventive health care services.
3030 SECTION 3. Sections 843.324 and 1301.070, Insurance Code,
3131 as added by this Act, apply only to a contract entered into or
3232 renewed on or after January 1, 2018.
3333 SECTION 4. This Act takes effect September 1, 2017.
