 A BILL TO BE ENTITLED
 AN ACT
 relating to provision of certain preventive health care services to
 certain health benefit plan and health maintenance organization
 enrollees.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter I, Chapter 843, Insurance Code, is
 amended by adding Section 843.324 to read as follows:
 Sec. 843.324.  CONTRACT PROVISION RELATING TO PREVENTIVE
 HEALTH CARE SERVICES. A contract between a health maintenance
 organization and a physician or provider requiring the physician or
 provider to provide preventive health care services to enrollees
 must require the physician or provider to provide covered
 preventive health care services to an enrollee not later than the
 30th day after the date the enrollee requests an appointment with
 the physician or provider for the preventive health care services.
 SECTION 2.  Subchapter B, Chapter 1301, Insurance Code, is
 amended by adding Section 1301.070 to read as follows:
 Sec. 1301.070.  CONTRACT PROVISION RELATING TO PREVENTIVE
 HEALTH CARE SERVICES. A preferred provider contract requiring the
 preferred provider to provide preventive health care services to
 insureds must require the preferred provider to provide covered
 preventive health care services to an insured not later than the
 30th day after the date the insured requests an appointment with the
 preferred provider for the preventive health care services.
 SECTION 3.  Sections 843.324 and 1301.070, Insurance Code,
 as added by this Act, apply only to a contract entered into or
 renewed on or after January 1, 2018.
 SECTION 4.  This Act takes effect September 1, 2017.
