11	4		AN ACT
12	5		relating to the licensing and regulation of military optometrists
13	6		and therapeutic optometrists who provide voluntary charity care.
14	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	8		SECTION 1. Subchapter F, Chapter 351, Occupations Code, is
16	9		amended by adding Section 351.266 to read as follows:
17	10		Sec. 351.266. MILITARY LIMITED VOLUNTEER LICENSE. (a) The
18	11		board shall adopt rules relating to the issuance of a military
19	12		limited volunteer license under this section.
20	13		(b) The board may issue a military limited volunteer license
21	14		to practice optometry or therapeutic optometry to an applicant who:
22	15		(1) is licensed and in good standing, or was licensed
23	16		and retired in good standing, as an optometrist or therapeutic
24	17		optometrist in another state;
25	18		(2) is or was authorized as an optometrist or
26	19		therapeutic optometrist to treat personnel enlisted in a branch of
27	20		the United States armed forces or veterans; and
28	21		(3) meets any other requirement prescribed by board
29	22		rule.
30	23		(c) The board may not issue a license under this section to
31	24		an applicant who:
32	25		(1) holds an optometry or therapeutic optometry
33	26		license that:
34	27		(A) is currently under active investigation; or
35	28		(B) is or was subject to a disciplinary order or
36	29		action or to denial by another jurisdiction;
37	30		(2) holds a license to prescribe, dispense,
38	31		administer, supply, or sell a controlled substance that:
39	32		(A) is currently under active investigation; or
40	33		(B) is or was subject to a disciplinary order or
41	34		action or to denial by another jurisdiction; or
42	35		(3) has been convicted of, is on deferred adjudication
43	36		community supervision or deferred disposition for, or is under
44	37		active investigation for the commission of:
45	38		(A) a felony; or
46	39		(B) a misdemeanor involving moral turpitude.
47	40		(d) An optometrist or therapeutic optometrist may practice
48	41		optometry or therapeutic optometry under a license issued under
49	42		this section only at a clinic that primarily treats indigent
50	43		patients. The optometrist or therapeutic optometrist may not
51	44		directly or indirectly receive compensation or anything of monetary
52	45		value for optometric services rendered at the clinic.
53	46		(e) A military limited volunteer license holder is subject
54	47		to board rules, including rules regarding disciplinary action,
55	48		license registration and renewal, and continuing medical
56	49		education.
57	50		SECTION 2. This Act takes effect September 1, 2017.
