114 AN ACT
125 relating to the licensing and regulation of military optometrists
136 and therapeutic optometrists who provide voluntary charity care.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Subchapter F, Chapter 351, Occupations Code, is
169 amended by adding Section 351.266 to read as follows:
1710 Sec. 351.266. MILITARY LIMITED VOLUNTEER LICENSE. (a) The
1811 board shall adopt rules relating to the issuance of a military
1912 limited volunteer license under this section.
2013 (b) The board may issue a military limited volunteer license
2114 to practice optometry or therapeutic optometry to an applicant who:
2215 (1) is licensed and in good standing, or was licensed
2316 and retired in good standing, as an optometrist or therapeutic
2417 optometrist in another state;
2518 (2) is or was authorized as an optometrist or
2619 therapeutic optometrist to treat personnel enlisted in a branch of
2720 the United States armed forces or veterans; and
2821 (3) meets any other requirement prescribed by board
2922 rule.
3023 (c) The board may not issue a license under this section to
3124 an applicant who:
3225 (1) holds an optometry or therapeutic optometry
3326 license that:
3427 (A) is currently under active investigation; or
3528 (B) is or was subject to a disciplinary order or
3629 action or to denial by another jurisdiction;
3730 (2) holds a license to prescribe, dispense,
3831 administer, supply, or sell a controlled substance that:
3932 (A) is currently under active investigation; or
4033 (B) is or was subject to a disciplinary order or
4134 action or to denial by another jurisdiction; or
4235 (3) has been convicted of, is on deferred adjudication
4336 community supervision or deferred disposition for, or is under
4437 active investigation for the commission of:
4538 (A) a felony; or
4639 (B) a misdemeanor involving moral turpitude.
4740 (d) An optometrist or therapeutic optometrist may practice
4841 optometry or therapeutic optometry under a license issued under
4942 this section only at a clinic that primarily treats indigent
5043 patients. The optometrist or therapeutic optometrist may not
5144 directly or indirectly receive compensation or anything of monetary
5245 value for optometric services rendered at the clinic.
5346 (e) A military limited volunteer license holder is subject
5447 to board rules, including rules regarding disciplinary action,
5548 license registration and renewal, and continuing medical
5649 education.
5750 SECTION 2. This Act takes effect September 1, 2017.
