| 12 | 12 | Code, is amended by adding Section 382.0521 to read as follows: | |
| 13 | 13 | Sec. 382.0521. TWO OR MORE PERMITTED FACILITIES IN | |
| 14 | 14 | FIVE-MILE RADIUS. The commission may not issue a permit under this | |
| 15 | 15 | chapter for a facility or a proposed facility if another facility | |
| 16 | 16 | permitted under this chapter is located within a five-mile radius | |
| 17 | 17 | of the facility or proposed facility. | |
| 18 | 18 | SECTION 2. This Act takes effect September 1, 2017. |
