A BILL TO BE ENTITLED
AN ACT
relating to a prohibition on the issuance of a permit under the
Clean Air Act for a facility located within a five-mile radius of
another permitted facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 382, Health and Safety
Code, is amended by adding Section 382.0521 to read as follows:
Sec. 382.0521. TWO OR MORE PERMITTED FACILITIES IN
FIVE-MILE RADIUS. The commission may not issue a permit under this
chapter for a facility or a proposed facility if another facility
permitted under this chapter is located within a five-mile radius
of the facility or proposed facility.
SECTION 2. This Act takes effect September 1, 2017.
