| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Article 103.0033(b), Code of Criminal Procedure, |
|---|
| 15 | 9 | | is amended to read as follows: |
|---|
| 16 | 10 | | (b) This article applies only to[: |
|---|
| 17 | 11 | | [(1)] a county or [with a population of 50,000 or |
|---|
| 18 | 12 | | greater; and |
|---|
| 19 | 13 | | [(2) a] municipality with a population of 100,000 or |
|---|
| 20 | 14 | | greater. |

| 21 | 15 | | SECTION 2. This Act takes effect immediately if it receives |

| 22 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |

| 24 | 18 | | Act does not receive the vote necessary for immediate effect, this |
