| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 8867.103, Special District Local Laws |
|---|
| 15 | 9 | | Code, is amended by amending Subsection (a) and adding Subsection |
|---|
| 16 | 10 | | (c) to read as follows: |
|---|
| 17 | 11 | | (a) The district may assess fees under Section 36.122(e) or |
|---|
| 18 | 12 | | 36.205(c), Water Code, in an annual amount not to exceed: |
|---|
| 19 | 13 | | (1) $1 per acre-foot of water used for agricultural |
|---|
| 20 | 14 | | use; [or] |
|---|
| 21 | 15 | | (2) 17 cents per thousand gallons of water used for any |
|---|
| 22 | 16 | | other purpose; or |
|---|
| 23 | 17 | | (3) notwithstanding any limitations on the amount of |
|---|
| 24 | 18 | | an export fee or surcharge authorized under Section 36.122(e), |
|---|
| 25 | 19 | | Water Code, 150 percent of the maximum commercial water rate |
|---|
| 26 | 20 | | charged by the City of Wichita Falls for groundwater exported from |
|---|
| 27 | 21 | | the district. |
|---|
| 28 | 22 | | (c) The district may use funds obtained from an export fee |
|---|
| 29 | 23 | | imposed under Subsection (a)(3) only to enhance: |
|---|
| 30 | 24 | | (1) aquifer monitoring, modeling, and data |
|---|
| 31 | 25 | | collection; and |
|---|
| 32 | 26 | | (2) research to advance the scientific understanding |
|---|
| 33 | 27 | | of the district's groundwater resources. |

| 34 | 28 | | SECTION 2. This Act takes effect September 1, 2017. |
