10 | 8 | | owned water utilities may contract for in a fiscal year. |

11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 10 | | SECTION 1. Section 2269.354(a), Government Code, is amended |
---|
13 | 11 | | to read as follows: |
---|
14 | 12 | | (a) After August 31, 2013: |
---|
15 | 13 | | (1) a governmental entity with a population of 500,000 |
---|
16 | 14 | | or more within the entity's geographic boundary or service area |
---|
17 | 15 | | may, under this subchapter, enter into contracts for not more than |
---|
18 | 16 | | six projects in any fiscal year; |
---|
19 | 17 | | (2) a municipally owned water utility with a separate |
---|
20 | 18 | | governing board appointed by the governing body of a municipality |
---|
21 | 19 | | with a population of 500,000 or more may: |
---|
22 | 20 | | (A) independently enter into contracts for not |
---|
23 | 21 | | more than four [two] civil works projects in any fiscal year; and |
---|
24 | 22 | | (B) enter into contracts for additional civil |
---|
25 | 23 | | works projects in any fiscal year, but not more than the number of |
---|
26 | 24 | | civil works projects prescribed by the limit in Subdivision (1) for |
---|
27 | 25 | | the municipality, provided that: |
---|
28 | 26 | | (i) the additional contracts for the civil |
---|
29 | 27 | | works projects entered into by the utility under this paragraph are |
---|
30 | 28 | | allocated to the number of contracts the municipality that appoints |
---|
31 | 29 | | the utility's governing board may enter under Subdivision (1); and |
---|
32 | 30 | | (ii) the governing body of the municipality |
---|
33 | 31 | | must approve the contracts; and |
---|
34 | 32 | | (3) a governmental entity that has a population of |
---|
35 | 33 | | 100,000 or more but less than 500,000 or is a board of trustees |
---|
36 | 34 | | governed by Chapter 54, Transportation Code, may enter into |
---|
37 | 35 | | contracts under this subchapter for not more than four projects in |
---|
38 | 36 | | any fiscal year. |
---|
39 | 37 | | SECTION 2. Section 2269.361(a), Government Code, is amended |
---|
40 | 38 | | to read as follows: |
---|
41 | 39 | | (a) A governmental entity shall request proposals from |
---|
42 | 40 | | design-build firms identified under Section 2269.359(c). A |
---|
43 | 41 | | response to a request for detailed proposals must be submitted on or |
---|
44 | 42 | | before the earlier of the time for submission as requested by the |
---|
45 | 43 | | governmental entity or [A firm must submit a proposal not later |
---|
46 | 44 | | than] the 180th day after the date the governmental entity makes a |
---|
47 | 45 | | public request for the proposals from the selected firms. The |
---|
48 | 46 | | request for proposals must include: |
---|
49 | 47 | | (1) a design criteria package; |
---|
50 | 48 | | (2) if the project site is identified, a geotechnical |
---|
51 | 49 | | baseline report or other information that provides the design-build |
---|
52 | 50 | | firm minimum geotechnical design parameters to submit a proposal; |
---|
53 | 51 | | (3) detailed instructions for preparing the technical |
---|
54 | 52 | | proposal and the items to be included, including a description of |
---|
55 | 53 | | the form and level of completeness of drawings expected; and |
---|
56 | 54 | | (4) the relative weighting of the technical and price |
---|
57 | 55 | | proposals and the formula by which the proposals will be evaluated |
---|
58 | 56 | | and ranked. |
---|
59 | 57 | | SECTION 3. Section 2269.361(a), Government Code, as amended |
---|
60 | 58 | | by this Act, applies only to a contract awarded on or after the |
---|
61 | 59 | | effective date of this Act. |
---|
62 | 60 | | SECTION 4. This Act takes effect immediately if it receives |
---|
63 | 61 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 62 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 63 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 64 | | Act takes effect September 1, 2017. |
