9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 438, Health and Safety Code, is amended | |
11 | 11 | by adding Subchapter E to read as follows: | |
12 | 12 | SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR | |
13 | 13 | CERTAIN FOOD SERVICE EMPLOYEES | |
14 | 14 | Sec. 438.051. APPLICABILITY. This subchapter applies only | |
15 | 15 | to a food service establishment with a designed or designated | |
16 | 16 | eating space. | |
17 | 17 | Sec. 438.052. CARDIOPULMONARY RESUSCITATION CERTIFICATION. | |
18 | 18 | (a) A food service establishment described by Section 438.051 may | |
19 | 19 | require each establishment employee whose job duties require | |
20 | 20 | regular interaction with customers eating food on the premises to | |
21 | 21 | be certified in cardiopulmonary resuscitation. | |
22 | 22 | (b) The instructor of a training course for the | |
23 | 23 | certification under this section must be authorized to provide the | |
24 | 24 | instruction by the American Heart Association, the American Red | |
25 | 25 | Cross, or a similar nationally recognized association. | |
26 | 26 | (c) A food service establishment may not discriminate in | |
27 | 27 | hiring based on whether an applicant is certified in | |
28 | 28 | cardiopulmonary resuscitation. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2017. |
