77 relating to cardiopulmonary resuscitation certification

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 438, Health and Safety Code, is amended
1111 by adding Subchapter E to read as follows:
1212 SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
1313 CERTAIN FOOD SERVICE EMPLOYEES
1414 Sec. 438.051. APPLICABILITY. This subchapter applies only
1515 to a food service establishment with a designed or designated
1616 eating space.
1717 Sec. 438.052. CARDIOPULMONARY RESUSCITATION CERTIFICATION.
1818 (a) A food service establishment described by Section 438.051 may
1919 require each establishment employee whose job duties require
2020 regular interaction with customers eating food on the premises to
2121 be certified in cardiopulmonary resuscitation.
2222 (b) The instructor of a training course for the
2323 certification under this section must be authorized to provide the
2424 instruction by the American Heart Association, the American Red
2525 Cross, or a similar nationally recognized association.
2626 (c) A food service establishment may not discriminate in
2727 hiring based on whether an applicant is certified in
2828 cardiopulmonary resuscitation.
2929 SECTION 2. This Act takes effect September 1, 2017.
