 A BILL TO BE ENTITLED
 AN ACT
 relating to cardiopulmonary resuscitation certification
 requirements for certain food service workers.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 438, Health and Safety Code, is amended
 by adding Subchapter E to read as follows:
 SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
 CERTAIN FOOD SERVICE EMPLOYEES
 Sec. 438.051.  APPLICABILITY. This subchapter applies only
 to a food service establishment with a designed or designated
 eating space.
 Sec. 438.052.  CARDIOPULMONARY RESUSCITATION CERTIFICATION.
 (a) A food service establishment described by Section 438.051 may
 require each establishment employee whose job duties require
 regular interaction with customers eating food on the premises to
 be certified in cardiopulmonary resuscitation.
 (b)  The instructor of a training course for the
 certification under this section must be authorized to provide the
 instruction by the American Heart Association, the American Red
 Cross, or a similar nationally recognized association.
 (c)  A food service establishment may not discriminate in
 hiring based on whether an applicant is certified in
 cardiopulmonary resuscitation.
 SECTION 2.  This Act takes effect September 1, 2017.
