1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the eligibility of certain persons to teach a driver
1313 education course.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 1001.112(a), Education Code, the
1616 substance of which was transferred from Section 521.205(a),
1717 Transportation Code, by Chapter 1044 (H.B. 1786), Acts of the 84th
1818 Legislature, Regular Session, 2015, is amended to conform to
1919 Chapter 567 (H.B. 2708), Acts of the 84th Legislature, Regular
2020 Session, 2015, and further amended to read as follows:
2121 (a) The commission by rule shall provide for approval of a
2222 driver education course conducted by a person designated under
2323 Subsection (a-1) or by the parent, stepparent, foster parent, legal
2424 guardian, grandparent, or step-grandparent of a person who is
2525 required to complete a driver education course to obtain a Class C
2626 license. The rules must provide that the student driver spend a
2727 minimum number of hours in classroom and behind-the-wheel
2828 instruction and that the person conducting the course:
2929 (1) possess a valid license for the preceding three
3030 years that has not been suspended, revoked, or forfeited in the past
3131 three years for an offense that involves the operation of a motor
3232 vehicle;
3333 (2) has not been convicted of:
3434 (A) criminally negligent homicide; or
3535 (B) driving while intoxicated; and
3636 (3) [is not disabled because of mental illness; and
3737 [(4)] does not have six or more points assigned to the
3838 person's driver's license under Subchapter B, Chapter 708,
3939 Transportation Code, at the time the person begins conducting the
4040 course.
4141 SECTION 2. Section 1001.112, Education Code, is amended by
4242 adding Subsection (a-1) to read as follows:
4343 (a-1) The parent of a person who is required to complete a
4444 driver education course to obtain a Class C license may designate a
4545 person 25 years of age or older to conduct a driver education course
4646 under Subsection (a) if the parent has a disability. In this
4747 subsection, "disability" means, with respect to an individual, a
4848 physical or mental impairment that substantially limits one or more
4949 major life activities.
5050 SECTION 3. (a) Section 521.1655(a-1), Transportation Code,
5151 is repealed.
5252 (b) Section 521.205(a), Transportation Code, as amended by
5353 Chapter 567 (H.B. 2708), Acts of the 84th Legislature, Regular
5454 Session, 2015, is repealed to conform to the repeal of Section
5555 521.205, Transportation Code, by Chapter 1044 (H.B. 1786), Acts of
5656 the 84th Legislature, Regular Session, 2015.
5757 SECTION 4. This Act takes effect September 1, 2017.
