| 12 | 12 | | relating to the eligibility of certain persons to teach a driver |
|---|

| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 1001.112(a), Education Code, the |
|---|
| 16 | 16 | | substance of which was transferred from Section 521.205(a), |
|---|
| 17 | 17 | | Transportation Code, by Chapter 1044 (H.B. 1786), Acts of the 84th |
|---|
| 18 | 18 | | Legislature, Regular Session, 2015, is amended to conform to |
|---|
| 19 | 19 | | Chapter 567 (H.B. 2708), Acts of the 84th Legislature, Regular |
|---|
| 20 | 20 | | Session, 2015, and further amended to read as follows: |
|---|
| 21 | 21 | | (a) The commission by rule shall provide for approval of a |
|---|
| 22 | 22 | | driver education course conducted by a person designated under |
|---|
| 23 | 23 | | Subsection (a-1) or by the parent, stepparent, foster parent, legal |
|---|
| 24 | 24 | | guardian, grandparent, or step-grandparent of a person who is |
|---|
| 25 | 25 | | required to complete a driver education course to obtain a Class C |
|---|
| 26 | 26 | | license. The rules must provide that the student driver spend a |
|---|
| 27 | 27 | | minimum number of hours in classroom and behind-the-wheel |
|---|
| 28 | 28 | | instruction and that the person conducting the course: |
|---|
| 29 | 29 | | (1) possess a valid license for the preceding three |
|---|
| 30 | 30 | | years that has not been suspended, revoked, or forfeited in the past |
|---|
| 31 | 31 | | three years for an offense that involves the operation of a motor |
|---|
| 32 | 32 | | vehicle; |
|---|
| 33 | 33 | | (2) has not been convicted of: |
|---|
| 34 | 34 | | (A) criminally negligent homicide; or |
|---|
| 35 | 35 | | (B) driving while intoxicated; and |
|---|
| 36 | 36 | | (3) [is not disabled because of mental illness; and |
|---|
| 37 | 37 | | [(4)] does not have six or more points assigned to the |
|---|
| 38 | 38 | | person's driver's license under Subchapter B, Chapter 708, |
|---|
| 39 | 39 | | Transportation Code, at the time the person begins conducting the |
|---|
| 40 | 40 | | course. |
|---|
| 41 | 41 | | SECTION 2. Section 1001.112, Education Code, is amended by |
|---|
| 42 | 42 | | adding Subsection (a-1) to read as follows: |
|---|
| 43 | 43 | | (a-1) The parent of a person who is required to complete a |
|---|
| 44 | 44 | | driver education course to obtain a Class C license may designate a |
|---|
| 45 | 45 | | person 25 years of age or older to conduct a driver education course |
|---|
| 46 | 46 | | under Subsection (a) if the parent has a disability. In this |
|---|
| 47 | 47 | | subsection, "disability" means, with respect to an individual, a |
|---|
| 48 | 48 | | physical or mental impairment that substantially limits one or more |
|---|
| 49 | 49 | | major life activities. |

| 50 | 50 | | SECTION 3. (a) Section 521.1655(a-1), Transportation Code, |
|---|
| 51 | 51 | | is repealed. |
|---|
| 52 | 52 | | (b) Section 521.205(a), Transportation Code, as amended by |
|---|
| 53 | 53 | | Chapter 567 (H.B. 2708), Acts of the 84th Legislature, Regular |
|---|
| 54 | 54 | | Session, 2015, is repealed to conform to the repeal of Section |
|---|
| 55 | 55 | | 521.205, Transportation Code, by Chapter 1044 (H.B. 1786), Acts of |
|---|
| 56 | 56 | | the 84th Legislature, Regular Session, 2015. |
