| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 33.73, Tax Code, is amended by adding |
|---|
| 9 | 15 | | Subsection (c) to read as follows: |
|---|
| 10 | 16 | | (c) The district clerk shall collect the fees taxed as costs |
|---|
| 11 | 17 | | of suit and award the fees to the master as required under |
|---|
| 12 | 18 | | Subsection (b) in each delinquent tax suit for which a master is |
|---|
| 13 | 19 | | appointed under Section 33.71, regardless of the disposition of the |
|---|
| 14 | 20 | | suit subject to this subsection. Fees may not be collected or |
|---|
| 15 | 21 | | awarded in a suit dismissed by the master unless the master: |
|---|
| 16 | 22 | | (1) held at least one hearing on the suit; or |
|---|
| 17 | 23 | | (2) prepared for the suit for at least a number of |
|---|
| 18 | 24 | | hours equivalent to the time typically required to conduct a |
|---|
| 19 | 25 | | hearing. |
|---|
| 20 | 26 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 21 | 27 | | to a delinquent tax suit for which a master is appointed that is |
|---|
| 22 | 28 | | filed on or after the effective date of this Act. |
|---|
| 23 | 29 | | SECTION 3. This Act takes effect September 1, 2017. |
