| 5 | 11 | | relating to the use of money subject to restrictions under federal |

| 6 | 12 | | law that is credited to the deferred maintenance fund account. |

| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 2165.403, Government Code, is amended by |
|---|
| 9 | 15 | | adding Subsection (d) to read as follows: |
|---|
| 10 | 16 | | (d) The use of money credited to the fund by appropriation |
|---|
| 11 | 17 | | or transfer from the game, fish, and water safety account, the |
|---|
| 12 | 18 | | lifetime license endowment account, or another fund or account in |
|---|
| 13 | 19 | | the state treasury the use of which is subject to restrictions under |
|---|
| 14 | 20 | | the federal Sport Fish Restoration Act (16 U.S.C. Section 777 et |
|---|
| 15 | 21 | | seq.), the federal Wildlife Restoration Act (16 U.S.C. Section 669 |
|---|
| 16 | 22 | | et seq.), or other federal law, and the use of money earned as |
|---|
| 17 | 23 | | interest or other earnings on the investment of that money credited |
|---|
| 18 | 24 | | to the fund, continues to be subject to those federal restrictions |
|---|
| 19 | 25 | | and may be used only for a function required to manage this state's |
|---|
| 20 | 26 | | fish or wildlife resources in accordance with those federal |
|---|
| 21 | 27 | | restrictions. |

| 22 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 32 | | Act takes effect September 1, 2017. |
