87 relating to an innovation grant program for community faith-based
98 programs that collaborate with the Department of Family and
109 Protective Services to improve foster care.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subchapter C, Chapter 264, Family Code, is
1312 amended by adding Section 264.2042 to read as follows:
1413 Sec. 264.2042. GRANTS FOR FAITH-BASED COMMUNITY
15- COLLABORATIVE PROGRAMS. (a) Using available funds or private
16- donations, the governor shall establish and administer an
17- innovation grant program to award grants to support faith-based
18- community programs that collaborate with the department and the
19- commission to improve foster care and the placement of children in
20- foster care.
14+ COLLABORATIVE PROGRAMS. (a) Subject to the availability of funds,
15+ the department shall establish and administer an innovation grant
16+ program, administered by the governor, to award grants to support
17+ faith-based community programs that collaborate with the
18+ department and the commission to improve foster care and the
19+ placement of children in foster care.
2120 (b) A faith-based community program is eligible for a grant
2221 under this section if:
2322 (1) the effectiveness of the program is supported by
2423 empirical evidence; and
2524 (2) the program has demonstrated the ability to build
2625 connections between faith-based, secular, and government
2726 stakeholders.
2827 (c) The regional director for the department in the region
2928 where a grant recipient program is located, or the regional
3029 director's designee, shall serve as the liaison between the
3130 department and the program for collaborative purposes. For a
3231 program that operates in a larger region, the department may
3332 designate a liaison in each county where the program is operating.
3433 The department or the commission may not direct or manage the
3534 operation of the program.
3635 (d) The initial duration of a grant under this section is
37- two years. The governor may renew a grant awarded to a program
38- under this section if funds are available and the governor
39- determines that the program is successful.
40- (e) The governor may not award to a program grants under
36+ two years. The department may renew a grant awarded to a program
37+ under this section if the department determines that the program is
38+ successful.
39+ (e) The department may not award to a program grants under
4140 this section totaling more than $300,000.
42- (f) The governor shall adopt rules to implement the grant
43- program created under this section.
41+ (f) The department and the governor shall adopt rules to
42+ implement the grant program created under this section.
4443 SECTION 2. As soon as practicable after the effective date
45- of this Act, the governor shall adopt rules for the implementation
46- and administration of the innovation grant program established
47- under Section 264.2042, Family Code, as added by this Act, and begin
48- to award grants under the program.

4949 SECTION 3. This Act takes effect September 1, 2017.
