10- A BILL TO BE ENTITLED
114 AN ACT
125 relating to the eligibility of the children of certain first
136 responders for free prekindergarten programs in public schools.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Section 29.153(b), Education Code, is amended to
169 read as follows:
1710 (b) A child is eligible for enrollment in a prekindergarten
1811 class under this section if the child is at least three years of age
1912 and:
2013 (1) is unable to speak and comprehend the English
2114 language;
2215 (2) is educationally disadvantaged;
2316 (3) is a homeless child, as defined by 42 U.S.C.
2417 Section 11434a, regardless of the residence of the child, of either
2518 parent of the child, or of the child's guardian or other person
2619 having lawful control of the child;
2720 (4) is the child of an active duty member of the armed
2821 forces of the United States, including the state military forces or
2922 a reserve component of the armed forces, who is ordered to active
3023 duty by proper authority;
3124 (5) is the child of a member of the armed forces of the
3225 United States, including the state military forces or a reserve
3326 component of the armed forces, who was injured or killed while
3427 serving on active duty; [or]
3528 (6) is or ever has been in the conservatorship of the
3629 Department of Family and Protective Services following an adversary
3730 hearing held as provided by Section 262.201, Family Code; or
3831 (7) is the child of a person eligible for the Star of
3932 Texas Award as:
4033 (A) a peace officer under Section 3106.002,
4134 Government Code;
4235 (B) a firefighter under Section 3106.003,
4336 Government Code; or
4437 (C) an emergency medical first responder under
4538 Section 3106.004, Government Code.
4639 SECTION 2. This Act applies beginning with the 2017-2018
4740 school year.
4841 SECTION 3. This Act takes effect immediately if it receives
4942 a vote of two-thirds of all the members elected to each house, as
5043 provided by Section 39, Article III, Texas Constitution. If this
5144 Act does not receive the vote necessary for immediate effect, this
5245 Act takes effect September 1, 2017.
