77 relating to the creation of the Heart of Texas Aquifer District and
88 the dissolution of certain groundwater conservation districts;
99 providing authority to issue bonds; providing authority to impose
1010 assessments, fees, or surcharges.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 ARTICLE 1. CREATION OF DISTRICT
1313 SECTION 1.1. CREATION OF DISTRICT. Subtitle H, Title 6,
1414 Special District Local Laws Code, is amended by adding Chapter 8892
1515 to read as follows:
1616 CHAPTER 8892. HEART OF TEXAS AQUIFER DISTRICT
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8892.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the board of directors of the
2020 district.
2121 (2) "Director" means a member of the board.
2222 (3) "District" means the Heart of Texas Aquifer
2323 District.
2424 Sec. 8892.002. NATURE OF DISTRICT. The district is a
2525 groundwater conservation district in Comal County created under and
2626 essential to accomplish the purposes of Section 59, Article XVI,
2727 Texas Constitution.
2828 Sec. 8892.003. INITIAL DISTRICT TERRITORY. The initial
2929 territory of the district:
3030 (1) consists of the territory of the following
3131 counties except as provided by Subdivision (2):
3232 (A) Blanco;
3333 (B) Burnet;
3434 (C) Comal;
3535 (D) Hays; and
3636 (E) Kendall; and
3737 (2) does not include territory included inside the
3838 territorial boundaries of the following districts as those
3939 boundaries are established on September 1, 2017:
4040 (A) the Barton Springs-Edwards Aquifer
4141 Conservation District;
4242 (B) the Edwards Aquifer Authority; or
4343 (C) the Plum Creek Conservation District.
4444 SUBCHAPTER B. BOARD OF DIRECTORS
4545 Sec. 8892.051. COMPOSITION OF BOARD. The district is
4646 governed by a board of five appointed directors.
4747 Sec. 8892.052. TERMS AND APPOINTMENT OF DIRECTORS.
4848 Directors serve staggered four-year terms. Directors are appointed
4949 as follows:
5050 (1) one director appointed by the Blanco County
5151 Commissioners Court;
5252 (2) one director appointed by the Burnet County
5353 Commissioners Court;
5454 (3) one director appointed by the Comal County
5555 Commissioners Court;
5656 (4) one director appointed by the Hays County
5757 Commissioners Court; and
5858 (5) one director appointed by the Kendall County
5959 Commissioners Court.
6060 Sec. 8892.053. VACANCIES. If there is a vacancy on the
6161 board, the commissioners court of the county that appointed the
6262 director whose position has become vacant shall appoint a person to
6363 fill the vacancy for the remainder of the term.
6464 SUBCHAPTER C. POWERS AND DUTIES
6565 Sec. 8892.101. GROUNDWATER CONSERVATION DISTRICT POWERS
6666 AND DUTIES. The district has the rights, powers, privileges,
6767 functions, and duties provided by the general law of this state,
6868 including Chapter 36, Water Code, applicable to groundwater
6969 conservation districts created under Section 59, Article XVI, Texas
7070 Constitution.
7171 Sec. 8892.102. CONTRACTS. The district may contract with a
7272 state agency or political subdivision, including a municipality, a
7373 county, a river authority, or another district, to carry out any
7474 function of the district.
7575 SECTION 1.2. APPOINTMENT OF DIRECTORS. Not later than
7676 September 1, 2018, the county commissioners courts of Blanco,
7777 Burnet, Comal, Hays, and Kendall Counties each shall appoint a
7878 member of the board of directors of the Heart of Texas Aquifer
7979 District as required by Section 8892.052, Special District Local
8080 Laws Code, as added by this Act.
8181 ARTICLE 2. TRANSFERS; DISSOLUTION OF DISTRICTS; REPEALER
8282 SECTION 2.1. DEFINITIONS. In this article:
8383 (1) "Aquifer district" means the Heart of Texas
8484 Aquifer District.
8585 (2) "Districts" means the following:
8686 (A) the Blanco-Pedernales Groundwater
8787 Conservation District;
8888 (B) the Central Texas Groundwater Conservation
8989 District;
9090 (C) the Comal Trinity Groundwater Conservation
9191 District;
9292 (D) the Cow Creek Groundwater Conservation
9393 District; and
9494 (E) the Hays Trinity Groundwater Conservation
9595 District.
9696 SECTION 2.2. TRANSFERS. (a) Not earlier than September 1,
9797 2018, and not later than December 1, 2018, each of the districts
9898 shall:
9999 (1) transfer the district's assets, debts, and
100100 contractual rights and obligations to the aquifer district; and
101101 (2) provide notice and make recordings of the
102102 transfers under this section as required by the Water Code,
103103 Property Code, and other law.
104104 (b) On December 1, 2018, the powers, functions, and duties
105105 of the districts are transferred to the aquifer district.
106106 SECTION 2.3. PROHIBITION ON CERTAIN ACTIONS. (a) Before
107107 December 1, 2018, the board of directors of the aquifer district:
108108 (1) may not take any regulatory action under Chapter
109109 36, Water Code;
110110 (2) shall adopt rules for the administration of the
111111 aquifer district under Chapter 36, Water Code; and
112112 (3) may hire employees of the aquifer district.
113113 (b) On and after December 1, 2018, the districts have no
114114 authority to take any action under Chapter 36, Water Code.
115115 SECTION 2.4. DISSOLUTION OF CERTAIN DISTRICTS. On January
116116 1, 2019:
117117 (1) the districts are dissolved;
118118 (2) the terms of the directors of the districts
119119 expire; and
120120 (3) the aquifer district shall provide to the Texas
121121 Commission on Environmental Quality notice of the dissolution of
122122 the districts.
123123 SECTION 2.5. REPEALER. On January 1, 2019:
124124 (1) Chapter 1147 (H.B. 3229), Acts of the 78th
125125 Legislature, Regular Session, 2003, is repealed; and
126126 (2) the following chapters of the Special District
127127 Local Laws Code are repealed:
128128 (A) Chapter 8810;
129129 (B) Chapter 8838;
130130 (C) Chapter 8843; and
131131 (D) Chapter 8875.
132132 ARTICLE 3. EFFECTIVE DATE
133133 SECTION 3.1. EFFECTIVE DATE. This Act takes effect
134134 September 1, 2017.
