| 5 | 11 | | relating to the uses of the lifetime license endowment account by |

| 6 | 12 | | the Parks and Wildlife Department. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 11.063, Parks and Wildlife Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | Sec. 11.063. USES OF ACCOUNT. To the extent allowed by |
|---|
| 11 | 17 | | federal law, money in the lifetime license endowment fund and |
|---|
| 12 | 18 | | interest [Interest] earned on the lifetime license endowment |
|---|
| 13 | 19 | | account may be used only for the purpose of managing the fish and |
|---|
| 14 | 20 | | wildlife resources of this state, as follows [to]: |
|---|
| 15 | 21 | | (1) acquiring [acquire] public hunting and fishing |
|---|
| 16 | 22 | | areas; [and] |
|---|
| 17 | 23 | | (2) developing, managing, and repairing [develop, |
|---|
| 18 | 24 | | manage, and repair] public hunting and fishing areas; and |
|---|
| 19 | 25 | | (3) making capital expenditures related to fisheries |
|---|
| 20 | 26 | | and wildlife resources, including: |
|---|
| 21 | 27 | | (A) land acquisition; |
|---|
| 22 | 28 | | (B) construction; and |
|---|
| 23 | 29 | | (C) the purchase of: |
|---|
| 24 | 30 | | (i) transportation items; |
|---|
| 25 | 31 | | (ii) equipment; and |
|---|
| 26 | 32 | | (iii) information technology resources. |
|---|
| 27 | 33 | | SECTION 2. Section 11.064, Parks and Wildlife Code, is |
|---|
| 28 | 34 | | amended to read as follows: |
|---|
| 29 | 35 | | Sec. 11.064. RESTRICTIONS. (a) No expenditure |
|---|
| 30 | 36 | | [expenditures] shall be made from the principal of the lifetime |
|---|
| 31 | 37 | | license endowment account if that expenditure would lower the |
|---|
| 32 | 38 | | unencumbered balance of the principal of the account below $20 |
|---|
| 33 | 39 | | million [except as provided by law]. |

| 34 | 40 | | (b) The interest earnings on and principal in the lifetime |
|---|
| 35 | 41 | | license endowment account may not be used to pay salaries or |
|---|
| 36 | 42 | | employee benefits. |

| 37 | 43 | | (c) The interest earnings on the lifetime license endowment |
|---|
| 38 | 44 | | account may be used for any purpose described by Section 11.063. |

| 39 | 45 | | (d) The principal in the lifetime license endowment account |

| 40 | 46 | | may be used only for the purpose described by Section 11.063(3). |

| 41 | 47 | | SECTION 3. This Act takes effect September 1, 2017. |
