| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife | |
| 11 | 11 | Code, is amended by adding Section 43.3595 to read as follows: | |
| 12 | 12 | Sec. 43.3595. TESTING BREEDER DEER FOR CHRONIC WASTING | |
| 13 | 13 | DISEASE. The department shall pay the costs associated with | |
| 14 | 14 | testing breeder deer for chronic wasting disease as that testing is | |
| 15 | 15 | required by a herd certification program administered by the | |
| 16 | 16 | federal Animal and Plant Health Inspection Service. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies to a | |
| 18 | 18 | breeder deer tested on or after the effective date of this Act. A | |
| 19 | 19 | breeder deer tested before the effective date of this Act is | |
| 20 | 20 | governed by the law in effect at the time the deer was tested and | |
| 21 | 21 | that law is continued in effect for that purpose. | |
| 22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2017. |
