A BILL TO BE ENTITLED
AN ACT
relating to the use of state money to pay certain payments,
including debt service payments, for public-private partnership
projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 2267, Government Code, is
amended by adding Section 2267.0601 to read as follows:
Sec. 2267.0601. USE OF STATE MONEY. To the extent the
payments are directly related to a qualifying project that serves
the public purpose of this chapter, a responsible governmental
entity may use state money to pay the following:
(1) a lease payment;
(2) a service payment;
(3) a user fee; or
(4) debt service.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
