13	6		AN ACT
14	7		relating to the eligibility of certain municipalities to establish
15		-	homestead preservation districts and reinvestment zones and to
16		-	certain regulatory prohibitions applicable in those districts and
17		-	zones.

18	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
19		-	SECTION 1. Section 214.905, Local Government Code, is
20		-	amended by adding Subsection (b-1) to read as follows:
21		-	(b-1) Subsection (b)(2) does not apply to a municipality
22		-	described by Section 373A.003(a)(2) in relation to a requirement
23		-	described by Subsection (a) that is proposed for an area served
24		-	under the provisions of Chapter 373A.
25		-	SECTION 2. Section 373A.002, Local Government Code, is

28	13		(3-a) "Low income household" means a household with a
29	14		gross income of not greater than 80 percent of the area median
30	15		family income, adjusted for household size, for the metropolitan
31	16		statistical area in which the municipality is located, as
32	17		determined annually by the United States Department of Housing and
33	18		Urban Development.
34	19		(3-b) "Project costs" has the meaning assigned by
35	20		Section 311.002(1), Tax Code.
36		-	SECTION 3. Section 373A.003(a), Local Government Code, is

38	23		(a) This chapter applies to:
39	24		(1) a municipality with a population of more than
40	25		750,000 that is located in a uniform state service region with fewer
41	26		than 550,000 occupied housing units as determined by the most
42	27		recent United States decennial census; and
43	28		(2) a municipality with a population of two million or
44	29		more.

48	33		(a) To be designated as a district within a municipality
49	34		described by Section 373A.003(a)(1) [373A.003(a)] under this
50	35		subchapter, an area must be composed of census tracts forming a
51	36		spatially compact area with:
52	37		(1) fewer than 75,000 residents;
53	38		(2) an overall poverty rate that is at least two times
54	39		the poverty rate for the entire municipality; and
55	40		(3) in each census tract within the area, a median
56	41		family income that is less than 80 percent of the median family
57	42		income for the entire municipality.
58	43		(a-1) To be designated as a district within a municipality
59	44		described by Section 373A.003(a)(2) under this subchapter:
60	45		(1) an area must be composed of census tracts forming a
61	46		spatially compact area; and
62	47		(2) the governing body of the municipality must make
63	48		findings by resolution that:
64	49		(A) the area will benefit from the inclusion of
65	50		low income households;
66	51		(B) low-income and moderate-income homeowners
67	52		within the area are at risk of losing their homesteads through
68	53		displacement; and
69	54		(C) the designation will serve one or more
70	55		purposes outlined by this chapter.
