44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to students actively working a program of recovery from a
77 substance use disorder at risk of dropping out of school.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 29.081(d), Education Code, is amended by
1010 adding subsection (14) to read as follows:
1111 (d) For purposes of this section, "student at risk of
1212 dropping out of school" includes each student who is under 26 years
1313 of age and who:
1414 (1) was not advanced from one grade level to the next
1515 for one or more school years;
1616 (2) if the student is in grade 7, 8, 9, 10, 11, or 12,
1717 did not maintain an average equivalent to 70 on a scale of 100 in two
1818 or more subjects in the foundation curriculum during a semester in
1919 the preceding or current school year or is not maintaining such an
2020 average in two or more subjects in the foundation curriculum in the
2121 current semester;
2222 (3) did not perform satisfactorily on an assessment
2323 instrument administered to the student under Subchapter B, Chapter
2424 39, and who has not in the previous or current school year
2525 subsequently performed on that instrument or another appropriate
2626 instrument at a level equal to at least 110 percent of the level of
2727 satisfactory performance on that instrument;
2828 (4) if the student is in prekindergarten,
2929 kindergarten, or grade 1, 2, or 3, did not perform satisfactorily on
3030 a readiness test or assessment instrument administered during the
3131 current school year;
3232 (5) is pregnant or is a parent;
3333 (6) has been placed in an alternative education
3434 program in accordance with Section 37.006 during the preceding or
3535 current school year;
3636 (7) has been expelled in accordance with Section
3737 37.007 during the preceding or current school year;
3838 (8) is currently on parole, probation, deferred
3939 prosecution, or other conditional release;
4040 (9) was previously reported through the Public
4141 Education Information Management System (PEIMS) to have dropped out
4242 of school;
4343 (10) is a student of limited English proficiency, as
4444 defined by Section 29.052;
4545 (11) is in the custody or care of the Department of
4646 Protective and Regulatory Services or has, during the current
4747 school year, been referred to the department by a school official,
4848 officer of the juvenile court, or law enforcement official;
4949 (12) is homeless, as defined by 42 U.S.C. Section
5050 11302, and its subsequent amendments; [or]
5151 (13) resided in the preceding school year or resides
5252 in the current school year in a residential placement facility in
5353 the district, including a detention facility, substance abuse
5454 treatment facility, emergency shelter, psychiatric hospital,
5555 halfway house, or foster group home; or
5656 (14) is actively working a program of recovery from a
5757 substance use disorder in a non-residential high school that
5858 partners with an onsite recovery program specifically designed for
5959 recovery support.
6060 SECTION 2. This Act takes effect September 1, 2017.
