| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 821.001(6), Government Code, is amended | |
| 9 | 9 | to read as follows: | |
| 10 | 10 | (6) "Employee" means a person who is employed , as | |
| 11 | 11 | determined by the retirement system, on other than a temporary | |
| 12 | 12 | basis by an employer in any position for at least one-half time at a | |
| 13 | 13 | regular rate of pay comparable to that of other persons employed in | |
| 14 | 14 | similar positions. The minimum number of hours required for | |
| 15 | 15 | one-half time employment must be the same for all categories of | |
| 16 | 16 | employees. | |
| 17 | 17 | SECTION 2. This Act applies beginning with the 2017-2018 | |
| 18 | 18 | school year. | |
| 19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the member s elected to each house , as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect , this | |
| 23 | 23 | Act takes effect September 1, 2017. |
