55 AN ACT
66 relating to the authorization of health benefit plans that do not
77 contain state-mandated health benefits.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 1507, Insurance Code, is amended by
1010 adding Subchapter C to read as follows:
1111 SUBCHAPTER C. CATASTROPHIC PLANS
1212 Sec. 1507.100. CATASTROPHIC HEALTH BENEFIT PLANS.
1313 Notwithstanding Subchapters A and B or any existing requirement, a
1414 health carrier or health maintenance organization may offer a
1515 catastrophic health benefit plan that does not include
1616 state-mandated health benefits as described by 1507.003(a) and
1717 1507.053(a).
1818 SECTION 2. The changes in law made by this Act apply only to
1919 a standard health benefit plan that is delivered, issued for
2020 delivery, or renewed on or after September 1, 2017. A policy
2121 delivered, issued for delivery, or renewed before September 1,
2222 2017, is governed by the law as it existed immediately before the
2323 effective date of this Act, and that law is continued in effect for
2424 that purpose.
2525 SECTION 3. This Act takes effect September 1, 2017.
