---|
25 | 33 | | Sec. 3954.001. DEFINITIONS. In this chapter: |

---|
28 | 36 | | (3) "Commission" means the Texas Commission on |
---|

---|
33 | 41 | | Sec. 3954.002. CREATION AND NATURE OF DISTRICT. The |
---|
34 | 42 | | district is a special district created under Sections 52 and 52-a, |
---|
35 | 43 | | Article III, and Section 59, Article XVI, Texas Constitution. |
---|
36 | 44 | | Sec. 3954.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The |
---|
37 | 45 | | creation of the district is essential to accomplish the purposes of |
---|
38 | 46 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
39 | 47 | | Texas Constitution, and other public purposes stated in this |
---|
40 | 48 | | chapter. By creating the district and in authorizing the city and |
---|
41 | 49 | | other political subdivisions to contract with the district, the |
---|
42 | 50 | | legislature has established a program to accomplish the public |
---|
43 | 51 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
44 | 52 | | (b) The creation of the district is necessary to promote, |
---|
45 | 53 | | develop, encourage, and maintain employment, commerce, |
---|
46 | 54 | | transportation, housing, tourism, recreation, the arts, |
---|
47 | 55 | | entertainment, economic development, safety, and the public |
---|
48 | 56 | | welfare in the district. |
---|
49 | 57 | | Sec. 3954.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a) |
---|
50 | 58 | | The district is created to serve a public use and benefit. |
---|
51 | 59 | | (b) All land and other property included in the district |
---|
52 | 60 | | will benefit from the improvements and services to be provided by |
---|
53 | 61 | | the district under powers conferred by Sections 52 and 52-a, |
---|
54 | 62 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
55 | 63 | | other powers granted under this chapter. |
---|
56 | 64 | | (c) The district is created to accomplish the purposes of a |
---|
57 | 65 | | municipal management district as provided by general law and |
---|
58 | 66 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
59 | 67 | | Texas Constitution. |
---|
60 | 68 | | (d) The creation of the district is in the public interest |
---|
61 | 69 | | and is essential to further the public purposes of: |
---|
62 | 70 | | (1) developing and diversifying the economy of the |
---|
63 | 71 | | state; |
---|
64 | 72 | | (2) eliminating unemployment and underemployment; |
---|
65 | 73 | | (3) developing or expanding transportation and |
---|
66 | 74 | | commerce; and |
---|
67 | 75 | | (4) providing quality residential housing. |
---|
68 | 76 | | (e) The district will: |
---|
69 | 77 | | (1) promote the health, safety, and general welfare of |
---|
70 | 78 | | residents, employers, potential employees, employees, visitors, |
---|
71 | 79 | | and consumers in the district, and of the public; |
---|
72 | 80 | | (2) provide needed funding for the district to |
---|
73 | 81 | | preserve, maintain, and enhance the economic health and vitality of |
---|
74 | 82 | | the district territory as a residential community and business |
---|
75 | 83 | | center; and |
---|
76 | 84 | | (3) promote the health, safety, welfare, and enjoyment |
---|
77 | 85 | | of the public by providing pedestrian ways and by landscaping and |
---|
78 | 86 | | developing certain areas in the district, which are necessary for |
---|
79 | 87 | | the restoration, preservation, and enhancement of scenic beauty. |
---|
80 | 88 | | (f) Pedestrian ways along or across a street, whether at |
---|
81 | 89 | | grade or above or below the surface, and street lighting, street |
---|
82 | 90 | | landscaping, parking, and street art objects are parts of and |
---|
83 | 91 | | necessary components of a street and are considered to be a street |
---|
84 | 92 | | or road improvement. |
---|
85 | 93 | | (g) The district will not act as the agent or |
---|
86 | 94 | | instrumentality of any private interest even though the district |
---|
87 | 95 | | will benefit many private interests as well as the public. |
---|
88 | 96 | | Sec. 3954.005. INITIAL DISTRICT TERRITORY. (a) The |
---|
89 | 97 | | district is initially composed of the territory described by |
---|
90 | 98 | | Section 4 of the Act enacting this chapter. |
---|
91 | 99 | | (b) The boundaries and field notes contained in Section 4 of |
---|
92 | 100 | | the Act enacting this chapter form a closure. A mistake in the |
---|
93 | 101 | | field notes or in copying the field notes in the legislative process |
---|
94 | 102 | | does not affect the district's: |
---|
95 | 103 | | (1) organization, existence, or validity; |
---|
96 | 104 | | (2) right to contract; |
---|
97 | 105 | | (3) authority to borrow money or issue bonds or other |
---|
98 | 106 | | obligations described by Section 3954.201 or to pay the principal |
---|
99 | 107 | | and interest of the bonds or other obligations; |
---|
100 | 108 | | (4) right to impose or collect an assessment or |
---|
101 | 109 | | collect other revenue; or |
---|
102 | 110 | | (5) legality or operation. |
---|
103 | 111 | | Sec. 3954.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
104 | 112 | | (a) All or any part of the area of the district is eligible to be |
---|
105 | 113 | | included in: |
---|
106 | 114 | | (1) a tax increment reinvestment zone created under |
---|
107 | 115 | | Chapter 311, Tax Code; |
---|
108 | 116 | | (2) a tax abatement reinvestment zone created under |
---|
109 | 117 | | Chapter 312, Tax Code; or |
---|
110 | 118 | | (3) an enterprise zone created under Chapter 2303, |
---|
111 | 119 | | Government Code. |
---|
112 | 120 | | (b) If the city creates a tax increment reinvestment zone |
---|
113 | 121 | | described by Subsection (a), the city and the board of directors of |
---|
114 | 122 | | the zone, by contract with the district, may grant money deposited |
---|
115 | 123 | | in the tax increment fund to the district to be used by the district |
---|
116 | 124 | | for: |
---|
117 | 125 | | (1) the purposes permitted for money granted to a |
---|
118 | 126 | | corporation under Section 380.002(b), Local Government Code; and |
---|
119 | 127 | | (2) any other district purpose, including the right to |
---|
120 | 128 | | pledge the money as security for any bonds or other obligations |
---|
121 | 129 | | issued by the district under Section 3954.201. |
---|
122 | 130 | | (c) If the city creates a tax increment reinvestment zone |
---|
123 | 131 | | described by Subsection (a), the city may determine the percentage |
---|
124 | 132 | | of the property in the zone that may be used for residential |
---|
125 | 133 | | purposes and is not subject to the limitations provided by Section |
---|
126 | 134 | | 311.006, Tax Code. |
---|
127 | 135 | | Sec. 3954.007. CONFIRMATION AND DIRECTORS' ELECTION |
---|
128 | 136 | | REQUIRED. The initial directors shall hold an election to confirm |
---|
129 | 137 | | the creation of the district and to elect five permanent directors |
---|
130 | 138 | | as provided by Section 49.102, Water Code. |
---|
131 | 139 | | Sec. 3954.008. CITY CONSENT AND DEVELOPMENT AGREEMENT |
---|
132 | 140 | | EXECUTION REQUIRED. The initial directors may not hold an election |
---|
133 | 141 | | under Section 3954.007 until the city has: |
---|
134 | 142 | | (1) consented by ordinance or resolution to the |
---|
135 | 143 | | creation of the district and to the inclusion of land in the |
---|
136 | 144 | | district; and |
---|
137 | 145 | | (2) entered into a development agreement with the |
---|
138 | 146 | | owners of the real property in the district under Section 212.172, |
---|
139 | 147 | | Local Government Code. |
---|
140 | 148 | | Sec. 3954.009. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
141 | 149 | | DISTRICT LAW. Except as provided by this chapter, Chapter 375, |
---|
142 | 150 | | Local Government Code, applies to the district. |
---|
306 | 302 | | Sec. 3954.155. RESIDENTIAL PROPERTY NOT EXEMPT. Sections |
---|
307 | 303 | | 375.161 and 375.164, Local Government Code, do not apply to the |
---|
308 | 304 | | district. |
---|
309 | 305 | | SUBCHAPTER E. TAXES AND BONDS |
---|
310 | 306 | | Sec. 3954.201. BONDS AND OTHER OBLIGATIONS. (a) The |
---|
311 | 307 | | district may issue, by public or private sale, bonds, notes, or |
---|
312 | 308 | | other obligations payable wholly or partly from ad valorem taxes or |
---|
313 | 309 | | assessments in the manner provided by Subchapter J, Chapter 375, |
---|
314 | 310 | | Local Government Code. |
---|
315 | 311 | | (b) If the improvements financed by an obligation will be |
---|
316 | 312 | | conveyed to or operated and maintained by a municipality or retail |
---|
317 | 313 | | utility provider pursuant to an agreement between the district and |
---|
318 | 314 | | the municipality or retail utility provider entered into before the |
---|
319 | 315 | | issuance of the obligation, the obligation may be issued in the |
---|
320 | 316 | | manner provided by Subchapter A, Chapter 372, Local Government |
---|
321 | 317 | | Code. |
---|
322 | 318 | | (c) In exercising the district's borrowing power, the |
---|
323 | 319 | | district may issue a bond or other obligation in the form of a bond, |
---|
324 | 320 | | note, certificate of participation or other instrument evidencing a |
---|
325 | 321 | | proportionate interest in payments to be made by the district, or |
---|
326 | 322 | | other type of obligation. |
---|
327 | 323 | | (d) In addition to the sources of money described by |
---|
328 | 324 | | Subchapter A, Chapter 372, and Subchapter J, Chapter 375, Local |
---|
329 | 325 | | Government Code, district bonds may be secured and made payable |
---|
330 | 326 | | wholly or partly by a pledge of any part of the money the district |
---|
331 | 327 | | receives from improvement revenue, receives under Section |
---|
332 | 328 | | 3954.006(b), or receives from any other source. |
---|
333 | 329 | | (e) The district may issue bonds, notes, or other |
---|
334 | 330 | | obligations to maintain or repair an existing improvement project |
---|
335 | 331 | | only if the district obtains written consent from the governing |
---|
336 | 332 | | body of the city. |
---|
337 | 333 | | Sec. 3954.202. ELECTIONS REGARDING TAXES AND BONDS. (a) |
---|
338 | 334 | | The district may issue, without an election, bonds, notes, and |
---|
339 | 335 | | other obligations secured by: |
---|
340 | 336 | | (1) revenue other than ad valorem taxes; or |
---|
341 | 337 | | (2) contract payments described by Section 3954.205. |
---|
342 | 338 | | (b) The district must hold an election in the manner |
---|
343 | 339 | | provided by Subchapter L, Chapter 375, Local Government Code, to |
---|
344 | 340 | | obtain voter approval before the district may impose an ad valorem |
---|
345 | 341 | | tax or issue bonds payable from ad valorem taxes. |
---|
346 | 342 | | (c) Section 375.243, Local Government Code, does not apply |
---|
347 | 343 | | to the district. |
---|
348 | 344 | | (d) All or any part of any facilities or improvements that |
---|
349 | 345 | | may be acquired by a district by the issuance of its bonds may be |
---|
350 | 346 | | submitted as a single proposition or as several propositions to be |
---|
351 | 347 | | voted on at the election. |
---|
352 | 348 | | Sec. 3954.203. TAXES FOR BONDS. At the time the district |
---|
353 | 349 | | issues bonds payable wholly or partly from ad valorem taxes, the |
---|
354 | 350 | | board shall provide for the annual imposition of a continuing |
---|
355 | 351 | | direct ad valorem tax, without limit as to rate or amount, while all |
---|
356 | 352 | | or part of the bonds are outstanding as required and in the manner |
---|
357 | 353 | | provided by Sections 54.601 and 54.602, Water Code. |
---|
358 | 354 | | Sec. 3954.204. OPERATION AND MAINTENANCE TAX. (a) If |
---|
359 | 355 | | authorized by a majority of the district voters voting at an |
---|
360 | 356 | | election held under Section 3954.202, the district may impose an |
---|
361 | 357 | | operation and maintenance tax on taxable property in the district |
---|
362 | 358 | | in accordance with Section 49.107, Water Code. |
---|
363 | 359 | | (b) The board shall determine the tax rate. The rate may not |
---|
364 | 360 | | exceed the rate approved at the election. |
---|
365 | 361 | | (c) Section 49.107(f), Water Code, does not apply to a |
---|
366 | 362 | | reimbursement made for a purpose described by Section 3954.102. |
---|
367 | 363 | | Sec. 3954.205. CONTRACT TAXES. (a) In accordance with |
---|
368 | 364 | | Section 49.108, Water Code, the district may impose a tax other than |
---|
369 | 365 | | an operation and maintenance tax and use the revenue derived from |
---|
370 | 366 | | the tax to make payments under a contract after the provisions of |
---|
371 | 367 | | the contract have been approved by a majority of the district voters |
---|
372 | 368 | | voting at an election held for that purpose. |
---|
373 | 369 | | (b) A contract approved by the district voters may contain a |
---|
374 | 370 | | provision stating that the contract may be modified or amended by |
---|
375 | 371 | | the board without further voter approval. |
---|
376 | 372 | | SUBCHAPTER F. DISSOLUTION |
---|
377 | 373 | | Sec. 3954.251. DISSOLUTION BY CITY ORDINANCE. (a) The |
---|
378 | 374 | | governing body of the city may dissolve the district by ordinance. |
---|
379 | 375 | | (b) The governing body may not dissolve the district until: |
---|
380 | 376 | | (1) water, sanitary, sewer, and drainage improvements |
---|
381 | 377 | | and roads have been constructed to serve at least 90 percent of the |
---|
382 | 378 | | developable territory of the district; and |
---|
383 | 379 | | (2) the district has reimbursed each party that has an |
---|
384 | 380 | | agreement with the district for all costs advanced to or on behalf |
---|
385 | 381 | | of the district. |
---|
386 | 382 | | (c) Until the district is dissolved, the district is |
---|
387 | 383 | | responsible for all bonds and other obligations of the district. |
---|
388 | 384 | | Sec. 3954.252. COLLECTION OF ASSESSMENTS AND OTHER REVENUE. |
---|
389 | 385 | | (a) If the dissolved district has bonds or other obligations |
---|
390 | 386 | | outstanding secured by and payable from assessments or other |
---|
391 | 387 | | revenue, other than revenue from ad valorem taxes, the city shall |
---|
392 | 388 | | succeed to the rights and obligations of the district regarding |
---|
393 | 389 | | enforcement and collection of the assessments or other revenue. |
---|
394 | 390 | | (b) The city shall have and exercise all district powers to |
---|
395 | 391 | | enforce and collect the assessments or other revenue to pay: |
---|
396 | 392 | | (1) the bonds or other obligations when due and |
---|
397 | 393 | | payable according to their terms; or |
---|
398 | 394 | | (2) special revenue or assessment bonds or other |
---|
399 | 395 | | obligations issued by the city to refund the outstanding bonds or |
---|
400 | 396 | | obligations. |
---|
401 | 397 | | Sec. 3954.253. ASSUMPTION OF ASSETS AND LIABILITIES. (a) |
---|
402 | 398 | | After the city dissolves the district, the city assumes the |
---|
403 | 399 | | obligations of the district, including any bonds or other debt |
---|
404 | 400 | | payable from assessments or other district revenue. |
---|
405 | 401 | | (b) If the city dissolves the district, the board shall |
---|
406 | 402 | | transfer ownership of all district property to the city. |
---|
407 | 403 | | SECTION 4. The Prairie Ridge Municipal Management District |
---|
