119 authority to impose assessments, fees, or taxes.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1412 Code, is amended by adding Chapter 3948 to read as follows:
1513 CHAPTER 3948. RIVER RANCH IMPROVEMENT DISTRICT OF LIBERTY COUNTY
1614 SUBCHAPTER A. GENERAL PROVISIONS
1715 Sec. 3948.001. DEFINITIONS. In this chapter:
1816 (1) "Board" means the district's board of directors.
1917 (2) "City" means the City of Dayton.
2018 (3) "County" means Liberty County.
2119 (4) "Director" means a board member.
2220 (5) "District" means the River Ranch Improvement
2321 District of Liberty County.
2422 Sec. 3948.002. NATURE OF DISTRICT. The district is a
2523 special district created under Section 59, Article XVI, Texas
2624 Constitution.
2725 Sec. 3948.003. PURPOSE; DECLARATION OF INTENT. (a) The
2826 creation of the district is essential to accomplish the purposes of
2927 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3028 Texas Constitution, and other public purposes stated in this
3129 chapter. By creating the district and in authorizing the city, the
3230 county, and other political subdivisions to contract with the
3331 district, the legislature has established a program to accomplish
3432 the public purposes set out in Section 52-a, Article III, Texas
3533 Constitution.
3634 (b) The creation of the district is necessary to promote,
3735 develop, encourage, and maintain employment, commerce,
3836 transportation, housing, tourism, recreation, the arts,
3937 entertainment, economic development, safety, and the public
4038 welfare in the district, and to accomplish the redevelopment of
4139 land in the district.
4240 (c) This chapter and the creation of the district may not be
4341 interpreted to relieve the city or the county from providing the
4442 level of services provided as of the effective date of the Act
4543 enacting this chapter to the area in the district. The district is
4644 created to supplement and not to supplant city or county services
4745 provided in the district.
4846 Sec. 3948.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
4947 The district is created to serve a public use and benefit.
5048 (b) All land and other property included in the district
5149 will benefit from the improvements and services to be provided by
5250 the district under powers conferred by Sections 52 and 52-a,
5351 Article III, and Section 59, Article XVI, Texas Constitution, and
5452 other powers granted under this chapter.
5553 (c) The creation of the district is in the public interest
5654 and is essential to further the public purposes of:
5755 (1) developing and diversifying the economy of the
5856 state;
5957 (2) eliminating unemployment and underemployment; and
6058 (3) developing or expanding transportation and
6159 commerce.
6260 (d) The district will:
6361 (1) promote the health, safety, and general welfare of
6462 residents, employers, potential employees, employees, visitors,
6563 and consumers in the district, and of the public;
6664 (2) provide needed funding for the district to
6765 preserve, maintain, and enhance the economic health and vitality of
6866 the district territory as a community and business center;
6967 (3) promote the health, safety, welfare, and enjoyment
7068 of the public by providing pedestrian ways and by landscaping and
7169 developing certain areas in the district, which are necessary for
7270 the restoration, preservation, and enhancement of scenic beauty;
7371 and
7472 (4) provide for road, transportation, and
7573 recreational facilities for the district.
7674 (e) Pedestrian ways along or across a street, whether at
7775 grade or above or below the surface, and street lighting, street
7876 landscaping, parking, and street art objects are parts of and
7977 necessary components of a street and are considered to be a street
8078 or road improvement.
8179 (f) The district will not act as the agent or
8280 instrumentality of any private interest even though the district
8381 will benefit many private interests as well as the public.
8482 Sec. 3948.005. INITIAL DISTRICT TERRITORY. (a) The
8583 district is initially composed of the territory described by
8684 Section 2 of the Act enacting this chapter.
8785 (b) The boundaries and field notes contained in Section 2 of
8886 the Act enacting this chapter form a closure. A mistake in the
8987 field notes or in copying the field notes in the legislative process
9088 does not affect the district's:
9189 (1) organization, existence, or validity;
9290 (2) right to issue any type of bonds for the purposes
9391 for which the district is created or to pay the principal of and
9492 interest on the bonds;
9593 (3) right to impose or collect an assessment or tax; or
9694 (4) legality or operation.
9795 Sec. 3948.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9896 All or any part of the area of the district is eligible to be
9997 included in:
10098 (1) a tax increment reinvestment zone created under
10199 Chapter 311, Tax Code;
102100 (2) a tax abatement reinvestment zone created under
103101 Chapter 312, Tax Code;
104102 (3) an enterprise zone created under Chapter 2303,
105103 Government Code; or
106104 (4) an industrial district created under Chapter 42,
107105 Local Government Code.
108106 Sec. 3948.007. APPLICABILITY OF MUNICIPAL MANAGEMENT
109107 DISTRICTS LAW. Except as otherwise provided by this chapter,
110108 Chapter 375, Local Government Code, applies to the district.
111109 Sec. 3948.008. CONSTRUCTION OF CHAPTER. This chapter shall
112110 be liberally construed in conformity with the findings and purposes
113111 stated in this chapter.
114112 SUBCHAPTER B. BOARD OF DIRECTORS
115113 Sec. 3948.051. GOVERNING BODY; TERMS. (a) The district is
116- governed by a board of five voting directors who serve staggered
117- terms of four years, with two or three directors' terms expiring
114+ governed by a board of nine voting directors who serve staggered
115+ terms of four years, with four or five directors' terms expiring
118116 June 1 of each odd-numbered year.
119117 (b) The board by resolution may change the number of voting
120118 directors on the board if the board determines that the change is in
121119 the best interest of the district. The board may not consist of
122120 fewer than 5 or more than 15 directors.
123121 Sec. 3948.052. APPOINTMENT OF VOTING DIRECTORS. The Texas
124122 Commission on Environmental Quality shall appoint voting directors
125123 from persons recommended by the board.
126124 Sec. 3948.053. NONVOTING DIRECTORS. The board may appoint
127125 nonvoting directors to serve at the pleasure of the voting
128126 directors.
129127 Sec. 3948.054. QUORUM. For purposes of determining the
130128 requirements for a quorum of the board, the following are not
131129 counted:
132130 (1) a board position vacant for any reason, including
133131 death, resignation, or disqualification;
134132 (2) a director who is abstaining from participation in
135133 a vote because of a conflict of interest; or
136134 (3) a nonvoting director.
137135 Sec. 3948.055. COMPENSATION. A director is entitled to
138136 receive fees of office and reimbursement for actual expenses as
139137 provided by Section 49.060, Water Code. Sections 375.069 and
140138 375.070, Local Government Code, do not apply to the board.
141139 Sec. 3948.056. INITIAL VOTING DIRECTORS. (a) The initial

161167 SUBCHAPTER C. POWERS AND DUTIES
162168 Sec. 3948.101. GENERAL POWERS AND DUTIES. The district has
163169 the powers and duties necessary to accomplish the purposes for
164170 which the district is created.
165171 Sec. 3948.102. IMPROVEMENT PROJECTS AND SERVICES. The
166172 district may provide, design, construct, acquire, improve,
167173 relocate, operate, maintain, or finance an improvement project or
168174 service using any money available to the district, or contract with
169175 a governmental or private entity to provide, design, construct,
170176 acquire, improve, relocate, operate, maintain, or finance an
171177 improvement project or service authorized under this chapter or
172178 Chapter 375, Local Government Code.
173179 Sec. 3948.103. DEVELOPMENT CORPORATION POWERS. The
174180 district, using money available to the district, may exercise the
175181 powers given to a development corporation under Chapter 505, Local
176182 Government Code, including the power to own, operate, acquire,
177183 construct, lease, improve, or maintain a project under that
178184 chapter.
179185 Sec. 3948.104. NONPROFIT CORPORATION. (a) The board by
180186 resolution may authorize the creation of a nonprofit corporation to
181187 assist and act for the district in implementing a project or
182188 providing a service authorized by this chapter.
183189 (b) The nonprofit corporation:
184190 (1) has each power of and is considered to be a local
185191 government corporation created under Subchapter D, Chapter 431,
186192 Transportation Code; and
187193 (2) may implement any project and provide any service
188194 authorized by this chapter.
189195 (c) The board shall appoint the board of directors of the
190196 nonprofit corporation. The board of directors of the nonprofit
191197 corporation shall serve in the same manner as the board of directors
192198 of a local government corporation created under Subchapter D,
193199 Chapter 431, Transportation Code, except that a board member is not
194200 required to reside in the district.
195201 Sec. 3948.105. AGREEMENTS; GRANTS. (a) As provided by
196202 Chapter 375, Local Government Code, the district may make an
197203 agreement with or accept a gift, grant, or loan from any person.
198204 (b) The implementation of a project is a governmental
199205 function or service for the purposes of Chapter 791, Government
200206 Code.
201207 Sec. 3948.106. LAW ENFORCEMENT SERVICES. To protect the
202208 public interest, the district may contract with a qualified party,
203209 including the county or the city, to provide law enforcement
204210 services in the district for a fee.
205211 Sec. 3948.107. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
206212 district may join and pay dues to a charitable or nonprofit
207213 organization that performs a service or provides an activity
208214 consistent with the furtherance of a district purpose.
209215 Sec. 3948.108. ECONOMIC DEVELOPMENT. (a) The district may
210216 engage in activities that accomplish the economic development
211217 purposes of the district.
212218 (b) The district may establish and provide for the
213219 administration of one or more programs to promote state or local
214220 economic development and to stimulate business and commercial
215221 activity in the district, including programs to:
216222 (1) make loans and grants of public money; and
217223 (2) provide district personnel and services.
218224 (c) The district may create economic development programs
219225 and exercise the economic development powers provided to
220226 municipalities by:
221227 (1) Chapter 380, Local Government Code; and
222228 (2) Subchapter A, Chapter 1509, Government Code.
223229 Sec. 3948.109. PARKING FACILITIES. (a) The district may
224230 acquire, lease as lessor or lessee, construct, develop, own,
225231 operate, and maintain parking facilities or a system of parking
226232 facilities, including lots, garages, parking terminals, or other
227233 structures or accommodations for parking motor vehicles off the
228234 streets and related appurtenances.
229235 (b) The district's parking facilities serve the public
230236 purposes of the district and are owned, used, and held for a public
231237 purpose even if leased or operated by a private entity for a term of
232238 years.
233239 (c) The district's parking facilities are parts of and
234240 necessary components of a street and are considered to be a street
235241 or road improvement.
236242 (d) The development and operation of the district's parking
237243 facilities may be considered an economic development program.
238244 Sec. 3948.110. ROAD DISTRICT POWERS. The district has the
239245 powers provided by the general laws relating to road districts and
240246 road utility districts created under Section 52(b), Article III,
241247 Texas Constitution, including Chapters 257 and 441, Transportation
242248 Code.
243249 Sec. 3948.111. ROAD STANDARDS AND REQUIREMENTS. (a) A road
244250 project must meet all applicable construction standards, zoning and
245251 subdivision requirements, and regulations of each municipality in
246252 whose corporate limits or extraterritorial jurisdiction the road
247253 project is located.
248254 (b) If a road project is not located in the corporate limits
249255 or extraterritorial jurisdiction of a municipality, the road
250256 project must meet all applicable construction standards,
251257 subdivision requirements, and regulations of each county in which
252258 the road project is located.
253259 (c) If the state will maintain and operate the road, the
254260 Texas Transportation Commission must approve the plans and
255261 specifications of the road project.
256262 Sec. 3948.112. NAVIGATION DISTRICT POWERS. (a) The
257263 district has the powers provided by the general law of this state
258264 applicable to navigation districts created under Section 59,
259265 Article XVI, Texas Constitution, including Chapters 60 and 62,
260266 Water Code.
261267 (b) The district may purchase, construct, acquire, own,
262268 operate, maintain, improve, or extend, inside and outside the
263269 district, a canal, waterway, bulkhead, dock, or other improvement
264270 or facility necessary or convenient to accomplish the navigation
265271 purposes of the district.
266272 Sec. 3948.113. RAIL FACILITIES. The district may
267273 construct, acquire, improve, maintain, and operate rail facilities
268274 and improvements in aid of those facilities.
269275 Sec. 3948.114. RURAL PUBLIC TRANSPORTATION POWERS. (a)
270276 The district may provide and coordinate rural public transportation
271277 in its territory in the manner provided by Sections 458.010 and
272278 458.011, Transportation Code, for a rural transit district.
273279 (b) Section 458.012(a), Transportation Code, does not apply
274280 to the operations of the district under Subsection (a).
275281 Sec. 3948.115. ANNEXATION OR EXCLUSION OF LAND. (a) The
276282 district may annex land as provided by Subchapter J, Chapter 49,
277283 Water Code.
278284 (b) The district may exclude land as provided by Subchapter
279285 J, Chapter 49, Water Code. Section 375.044(b), Local Government
280286 Code, does not apply to the district.
281287 Sec. 3948.116. NO EMINENT DOMAIN POWER. The district may
282288 not exercise the power of eminent domain.
283289 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS
284290 Sec. 3948.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The
285291 board by resolution shall establish the number of directors'
286292 signatures and the procedure required for a disbursement or
287293 transfer of district money.
288294 Sec. 3948.152. MONEY USED FOR IMPROVEMENTS OR SERVICES.
289295 The district may acquire, construct, finance, operate, or maintain
290296 any improvement or service authorized under this chapter or Chapter
291297 375, Local Government Code, using any money available to the
292298 district.
293299 Sec. 3948.153. PETITION REQUIRED FOR FINANCING SERVICES AND
294300 IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
295301 service or improvement project with assessments under this chapter
296302 unless a written petition requesting that service or improvement
297303 has been filed with the board.
298304 (b) A petition filed under Subsection (a) must be signed by
299305 the owners of a majority of the assessed value of real property in
300306 the district subject to assessment according to the most recent
301307 certified tax appraisal roll for the county.
302308 Sec. 3948.154. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
303309 The board by resolution may impose and collect an assessment for any
304310 purpose authorized by this chapter in all or any part of the
305311 district.
306312 (b) An assessment, a reassessment, or an assessment
307313 resulting from an addition to or correction of the assessment roll
308314 by the district, penalties and interest on an assessment or
309315 reassessment, an expense of collection, and reasonable attorney's
310316 fees incurred by the district:
311317 (1) are a first and prior lien against the property
312318 assessed;
313319 (2) are superior to any other lien or claim other than
314320 a lien or claim for county, school district, or municipal ad valorem
315321 taxes; and
316322 (3) are the personal liability of and a charge against
317323 the owners of the property even if the owners are not named in the
318324 assessment proceedings.
319325 (c) The lien is effective from the date of the board's
320326 resolution imposing the assessment until the date the assessment is
321327 paid. The board may enforce the lien in the same manner that the
322328 board may enforce an ad valorem tax lien against real property.
323329 (d) The board may make a correction to or deletion from the
324330 assessment roll that does not increase the amount of assessment of
325331 any parcel of land without providing notice and holding a hearing in
326332 the manner required for additional assessments.
327333 Sec. 3948.155. RESIDENTIAL PROPERTY NOT EXEMPT. Section
328334 375.161, Local Government Code, does not apply to a tax authorized
329335 or approved by the voters of the district or a required payment for
330336 a service provided by the district, including water and sewer
331337 services.
332338 Sec. 3948.156. COMPETITIVE BIDDING. Subchapter I, Chapter
333339 49, Water Code, applies to the district. Sections 375.221 and
334340 375.223, Local Government Code, do not apply to the district.
335341 Sec. 3948.157. TAX AND ASSESSMENT ABATEMENTS. The district
336342 may designate reinvestment zones and may grant abatements of
337343 district taxes or assessments on property in the zones.
338344 SUBCHAPTER E. TAXES AND BONDS
339345 Sec. 3948.201. ELECTIONS REGARDING TAXES AND BONDS. (a)
340346 The district may issue, without an election, bonds, notes, and
341347 other obligations secured by:
342348 (1) revenue other than ad valorem taxes; or
343349 (2) contract payments described by Section 3948.203.
344350 (b) The district must hold an election in the manner
345351 provided by Subchapter L, Chapter 375, Local Government Code, to
346352 obtain voter approval before the district may impose an ad valorem
347353 tax or issue bonds payable from ad valorem taxes.
348354 (c) Section 375.243, Local Government Code, does not apply
349355 to the district.
350356 (d) All or any part of any facilities or improvements that
351357 may be acquired by a district by the issuance of its bonds may be
352358 submitted as a single proposition or as several propositions to be
353359 voted on at the election.
354360 Sec. 3948.202. OPERATION AND MAINTENANCE TAX. (a) If
355361 authorized by a majority of the district voters voting at an
356362 election held in accordance with Section 3948.201, the district may
357363 impose an operation and maintenance tax on taxable property in the
358364 district in accordance with Section 49.107, Water Code, for any
359365 district purpose, including to:
360366 (1) maintain and operate the district;
361367 (2) construct or acquire improvements; or
362368 (3) provide a service.
363369 (b) The board shall determine the tax rate. The rate may not
364370 exceed the rate approved at the election.
365371 (c) Section 49.107(h), Water Code, does not apply to the
366372 district.
367373 Sec. 3948.203. CONTRACT TAXES. (a) In accordance with
368374 Section 49.108, Water Code, the district may impose a tax other than
369375 an operation and maintenance tax and use the revenue derived from
370376 the tax to make payments under a contract after the provisions of
371377 the contract have been approved by a majority of the district voters
372378 voting at an election held for that purpose.
373379 (b) A contract approved by the district voters may contain a
374380 provision stating that the contract may be modified or amended by
375381 the board without further voter approval.
376382 Sec. 3948.204. AUTHORITY TO BORROW MONEY AND TO ISSUE BONDS
377383 AND OTHER OBLIGATIONS. (a) The district may borrow money on terms
378384 determined by the board. Section 375.205, Local Government Code,
379385 does not apply to a loan, line of credit, or other borrowing from a
380386 bank or financial institution secured by revenue other than ad
381387 valorem taxes.
382388 (b) The district may issue bonds, notes, or other
383389 obligations payable wholly or partly from ad valorem taxes,
384390 assessments, impact fees, revenue, contract payments, grants, or
385391 other district money, or any combination of those sources of money,
386392 to pay for any authorized district purpose.
387393 Sec. 3948.205. TAXES FOR BONDS. At the time the district
388394 issues bonds payable wholly or partly from ad valorem taxes, the
389395 board shall provide for the annual imposition of a continuing
390396 direct annual ad valorem tax, without limit as to rate or amount,
391397 for each year that all or part of the bonds are outstanding as
392398 required and in the manner provided by Sections 54.601 and 54.602,
393399 Water Code.
394400 Sec. 3948.206. BONDS FOR ROAD PROJECTS. At the time of
395401 issuance, the total principal amount of bonds or other obligations
396402 issued or incurred to finance road projects and payable from ad
397403 valorem taxes may not exceed one-fourth of the assessed value of the
398404 real property in the district.
399405 SUBCHAPTER F. DEFINED AREAS
400406 Sec. 3948.251. AUTHORITY TO ESTABLISH DEFINED AREAS OR
401407 DESIGNATED PROPERTY. The district may define areas or designate
402408 certain property of the district to pay for improvements,
403409 facilities, or services that primarily benefit that area or
404410 property and do not generally and directly benefit the district as a
405411 whole.
406412 Sec. 3948.252. PROCEDURE FOR ELECTION. (a) Before the
407413 district may impose an ad valorem tax or issue bonds payable from ad
408414 valorem taxes of the defined area or designated property, the board
409415 shall hold an election in the defined area or in the designated
410416 property only.
411417 (b) The board may submit the issues to the voters on the same
412418 ballot to be used in another election.
413419 Sec. 3948.253. DECLARING RESULT AND ISSUING ORDER. (a) If
414420 a majority of the voters voting at the election approve the
415421 proposition or propositions, the board shall declare the results
416422 and, by order, shall establish the defined area and describe it by
417423 metes and bounds or designate the specific property.
418424 (b) A court may not review the board's order except on the
419425 ground of fraud, palpable error, or arbitrary and confiscatory
420426 abuse of discretion.
421427 Sec. 3948.254. TAXES FOR SERVICES, IMPROVEMENTS, AND
422428 FACILITIES IN DEFINED AREAS OR DESIGNATED PROPERTY. On voter
423429 approval and adoption of the order described by Section 3948.253,
424430 the district may apply separately, differently, equitably, and
425431 specifically its taxing power and lien authority to the defined
426432 area or designated property to provide money to construct,
427433 administer, maintain, and operate services, improvements, and
428434 facilities that primarily benefit the defined area or designated
429435 property.
430436 Sec. 3948.255. ISSUANCE OF BONDS FOR DEFINED AREA OR
431437 DESIGNATED PROPERTY. After the order under Section 3948.253 is
432438 adopted, the district may issue bonds to provide for any land,
433439 improvements, facilities, plants, equipment, and appliances for
434440 the defined area or designated property.
435441 SECTION 2. The River Ranch Improvement District of Liberty
436442 County initially includes all territory contained in the following
437443 area:

439- Being 6980.02 acres of land situated in the William Bloodgood
444+ Tract 1:
445+ Being 6980.694 acres of land situated in the William Bloodgood
440446 Survey, Abstract 3, the William D. Smith Survey, Abstract 106, the
441447 H. E. & W. RR. Number 1131 Survey, Abstract 515, the William E.
442448 Kierstead Survey, Abstract 693, the George Pace Survey, Abstract
443449 805, the Louis Davis Survey, Abstract 18, the A. P. Blackwell
444450 Survey, Abstract 782, the Robert Wiseman Survey, Abstract 392, and
445451 the T. & N. O. RR. Survey, Abstract 383, in Liberty County, Texas,
446452 and being the residue of that called 7449.781 acres of land as
447453 recorded in Liberty County Clerk's File Number 2009008952 and being
448454 more particularly described by metes and bounds as follows;
449455 BEGINNING, at a found five eighths inch iron rod, marking the most
450456 northwesterly corner of said called 7450.588 acre tract, the

796930 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
797931 Government Code.
798932 (b) The governor, one of the required recipients, has
799933 submitted the notice and Act to the Texas Commission on
800934 Environmental Quality.
801935 (c) The Texas Commission on Environmental Quality has filed
802936 its recommendations relating to this Act with the governor,
803937 lieutenant governor, and speaker of the house of representatives
804938 within the required time.
805939 (d) The general law relating to consent by political
806940 subdivisions to the creation of districts with conservation,
807941 reclamation, and road powers and the inclusion of land in those

813947 SECTION 4. This Act takes effect immediately if it receives
814948 a vote of two-thirds of all the members elected to each house, as
815949 provided by Section 39, Article III, Texas Constitution. If this
816950 Act does not receive the vote necessary for immediate effect, this
817951 Act takes effect September 1, 2017.
