104 AN ACT
115 relating to a waiver for certain programs from youth camp
126 licensing.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Chapter 141, Health and Safety Code, is amended
159 by adding Section 141.0025 to read as follows:
1610 Sec. 141.0025. WAIVER; APPEAL. (a) The department may
1711 grant a waiver from the requirements of this chapter to a program
1812 that:
1913 (1) is sponsored by a religious organization as
2014 defined by Section 464.051;
2115 (2) has been in operation for at least 30 consecutive
2216 years;
2317 (3) operates one camp for not more than seven days in
2418 any year;
2519 (4) has not more than 80 campers;
2620 (5) is conducted by adult participants who are all
2721 volunteers;
2822 (6) operates in a county with a population of at least
2923 4,400 but not more than 4,750; and
3024 (7) ensures that background checks are conducted on
3125 and the training required under Section 141.0095 is completed by
3226 each adult participating in the program.
3327 (b) A waiver granted by the department under Subsection (a)
3428 is valid until the waiver is revoked for cause by the department.
3529 (c) A person who operates a program for which an application
3630 for a waiver under this section has been denied or for which a
3731 waiver under this section has been revoked may appeal the action in
3832 the manner provided for appeal of contested cases under Chapter
3933 2001, Government Code.
4034 SECTION 2. As soon as practicable after the effective date
4135 of this Act, the executive commissioner of the Health and Human
4236 Services Commission shall adopt rules necessary to implement
4337 Section 141.0025, Health and Safety Code, as added by this Act.
4438 SECTION 3. This Act takes effect September 1, 2017.
