11 | 5 | | relating to a waiver for certain programs from youth camp |

13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Chapter 141, Health and Safety Code, is amended |
---|
15 | 9 | | by adding Section 141.0025 to read as follows: |
---|
16 | 10 | | Sec. 141.0025. WAIVER; APPEAL. (a) The department may |
---|
17 | 11 | | grant a waiver from the requirements of this chapter to a program |
---|
18 | 12 | | that: |
---|
19 | 13 | | (1) is sponsored by a religious organization as |
---|
20 | 14 | | defined by Section 464.051; |
---|
21 | 15 | | (2) has been in operation for at least 30 consecutive |
---|
22 | 16 | | years; |
---|
23 | 17 | | (3) operates one camp for not more than seven days in |
---|
24 | 18 | | any year; |
---|
25 | 19 | | (4) has not more than 80 campers; |
---|
26 | 20 | | (5) is conducted by adult participants who are all |
---|
27 | 21 | | volunteers; |
---|
28 | 22 | | (6) operates in a county with a population of at least |
---|
29 | 23 | | 4,400 but not more than 4,750; and |
---|
30 | 24 | | (7) ensures that background checks are conducted on |
---|
31 | 25 | | and the training required under Section 141.0095 is completed by |
---|
32 | 26 | | each adult participating in the program. |
---|
33 | 27 | | (b) A waiver granted by the department under Subsection (a) |
---|
34 | 28 | | is valid until the waiver is revoked for cause by the department. |
---|
35 | 29 | | (c) A person who operates a program for which an application |
---|
36 | 30 | | for a waiver under this section has been denied or for which a |
---|
37 | 31 | | waiver under this section has been revoked may appeal the action in |
---|
38 | 32 | | the manner provided for appeal of contested cases under Chapter |
---|
39 | 33 | | 2001, Government Code. |
---|
40 | 34 | | SECTION 2. As soon as practicable after the effective date |
---|
41 | 35 | | of this Act, the executive commissioner of the Health and Human |
---|
42 | 36 | | Services Commission shall adopt rules necessary to implement |
---|
43 | 37 | | Section 141.0025, Health and Safety Code, as added by this Act. |
---|
44 | 38 | | SECTION 3. This Act takes effect September 1, 2017. |
