12	5		relating to the disposal of pesticides.
13	6		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	7		SECTION 1. Subchapter A, Chapter 76, Agriculture Code, is
15	8		amended by adding Section 76.009 to read as follows:
16	9		Sec. 76.009. PESTICIDE DISPOSAL FUND. (a) The pesticide
17	10		disposal fund is a fund in the state treasury outside the general
18	11		revenue fund. The fund consists of:
19	12		(1) money deposited to the credit of the fund under
20	13		Section 76.044; and
21	14		(2) interest earned on the investment of money in the
22	15		fund.
23	16		(b) The department shall administer the fund. Money in the
24	17		fund may be appropriated only for the purposes of the pesticide
25	18		waste and pesticide container collection activities performed
26	19		under Section 76.132.
27	20		SECTION 2. Section 76.044, Agriculture Code, is amended by
28	21		adding Subsection (c) to read as follows:
29	22		(c) Of the money received by the department under this
30	23		section, the department shall annually deposit to the credit of the
31	24		pesticide disposal fund under Section 76.009 an amount to cover the
32	25		cost of administering the pesticide waste and pesticide container
33	26		collection activities performed under Section 76.132, not to exceed
34	27		$400,000.
35	28		SECTION 3. Subchapter F, Chapter 76, Agriculture Code, is
36	29		amended by adding Section 76.132 to read as follows:
37	30		Sec. 76.132. DISPOSAL OF PESTICIDE. The department, in
38	31		coordination with the Texas Commission on Environmental Quality and
39	32		the Texas A&M AgriLife Extension Service, shall organize pesticide
40	33		waste and pesticide container collection activities statewide. The
41	34		department, the Texas Commission on Environmental Quality, and the
42	35		Texas A&M AgriLife Extension Service may contract for the services
43	36		of contractors that are licensed in the disposal of hazardous waste
44	37		under Section 401.202, Health and Safety Code, or other contractors
45	38		to implement the pesticide waste and pesticide container collection
46	39		activities and facilitate the collection of canceled,
47	40		unregistered, or otherwise unwanted pesticide products and
48	41		pesticide containers.
49	42		SECTION 4. This Act takes effect September 1, 2017.
