86 AN ACT
97 relating to the punishment for the offense of aggravated assault.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Sections 22.02(b) and (d), Penal Code, are
1210 amended to read as follows:
1311 (b) An offense under this section is a felony of the second
1412 degree, except that the offense is a felony of the first degree if:
1513 (1) the actor uses a deadly weapon during the
1614 commission of the assault and causes serious bodily injury to a
1715 person whose relationship to or association with the defendant is
1816 described by Section 71.0021(b), 71.003, or 71.005, Family Code;
1917 (2) regardless of whether the offense is committed
2018 under Subsection (a)(1) or (a)(2), the offense is committed:
2119 (A) by a public servant acting under color of the
2220 servant's office or employment;
2321 (B) against a person the actor knows is a public
2422 servant while the public servant is lawfully discharging an
2523 official duty, or in retaliation or on account of an exercise of
2624 official power or performance of an official duty as a public
2725 servant;
2826 (C) in retaliation against or on account of the
2927 service of another as a witness, prospective witness, informant, or
3028 person who has reported the occurrence of a crime; or
3129 (D) against a person the actor knows is a
3230 security officer while the officer is performing a duty as a
3331 security officer; [or]
3432 (3) the actor is in a motor vehicle, as defined by
3533 Section 501.002, Transportation Code, and:
3634 (A) knowingly discharges a firearm at or in the
3735 direction of a habitation, building, or vehicle;
3836 (B) is reckless as to whether the habitation,
3937 building, or vehicle is occupied; and
4038 (C) in discharging the firearm, causes serious
4139 bodily injury to any person; or
4240 (4) the offense is committed under Subsection (a)(1)
4341 and the actor's conduct resulted in the paralysis of the victim of
4442 the offense.
4543 (d) In this section:
4644 (1) "Paralysis" means, with respect to the human body,
4745 the complete and permanent loss, in part or most of the body, of
4846 feeling or the ability to move, resulting in loss of the ability to
4947 walk.
5048 (2) "Security [, "security] officer" means a
5149 commissioned security officer as defined by Section 1702.002,
5250 Occupations Code, or a noncommissioned security officer registered
5351 under Section 1702.221, Occupations Code.
5452 SECTION 2. The change in law made by this Act applies only
5553 to an offense committed on or after the effective date of this Act.
5654 An offense committed before the effective date of this Act is
5755 governed by the law in effect on the date the offense was committed,
5856 and the former law is continued in effect for that purpose. For
5957 purposes of this section, an offense was committed before the
6058 effective date of this Act if any element of the offense occurred
6159 before that date.
6260 SECTION 3. This Act takes effect September 1, 2017.
