66 AN ACT
77 relating to procedures of a county tax assessor-collector for
88 collection of dishonored checks and invoices; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.006, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 130.006. PROCEDURES FOR COLLECTION OF DISHONORED
1313 CHECKS AND INVOICES. (a) A county tax assessor-collector may
1414 establish procedures for the collection of dishonored checks and
1515 credit card invoices. The procedures may include:
1616 (1) official notification to the maker that the check
1717 or invoice has not been honored and that the receipt, registration,
1818 certificate, or other instrument issued on the receipt of the check
1919 or invoice is not valid until payment of the fee or tax is made;
2020 (2) notification of the sheriff or other law
2121 enforcement officers that a check or credit card invoice has not
2222 been honored and that the receipt, registration, certificate, or
2323 other instrument held by the maker is not valid; [and]
2424 (3) notification to the Texas Department of Motor
2525 Vehicles, the comptroller of public accounts, or the Department of
2626 Public Safety that the receipt, registration, certificate, or other
2727 instrument held by the maker is not valid; and
2828 (4) referral of a dishonored check or credit card
2929 invoice to a private collection agency.
3030 (b) If the county tax assessor-collector refers a
3131 dishonored check or credit card invoice to a private collection
3232 agency under Subsection (a)(4), the private collection agency may
3333 charge a fee to the person responsible for the check or invoice in
3434 an amount equal to any amount authorized for a returned check under
3535 Section 118.011.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2017.
