| 69 | 67 | | SECTION 2. Section 102.107, Health and Safety Code, is |
|---|
| 70 | 68 | | amended to read as follows: |
|---|
| 71 | 69 | | Sec. 102.107. POWERS AND DUTIES. (a) The oversight |
|---|
| 72 | 70 | | committee shall: |
|---|
| 73 | 71 | | (1) hire a chief executive officer; |
|---|
| 74 | 72 | | (2) annually set priorities as prescribed by the |
|---|
| 75 | 73 | | legislature for each grant program that receives money under this |
|---|
| 76 | 74 | | chapter; and |
|---|
| 77 | 75 | | (3) consider the priorities set under Subdivision (2) |
|---|
| 78 | 76 | | in awarding grants under this chapter. |
|---|
| 79 | 77 | | (b) The oversight committee may conduct a closed meeting in |
|---|
| 80 | 78 | | accordance with Subchapter E, Chapter 551, Government Code, to |
|---|
| 81 | 79 | | discuss issues related to managing, acquiring, or selling |
|---|
| 82 | 80 | | securities or other revenue-sharing obligations realized under the |
|---|
| 83 | 81 | | standards established as required by Section 102.256. |
|---|
| 84 | 82 | | SECTION 3. Section 102.203(e), Health and Safety Code, is |
|---|
| 85 | 83 | | amended to read as follows: |
|---|
| 86 | 84 | | (e) Not more than 10 percent of the money appropriated by |
|---|
| 87 | 85 | | the legislature for grants in a state fiscal year [awarded under |
|---|
| 88 | 86 | | this subchapter] may be used for cancer prevention and control |
|---|
| 89 | 87 | | programs during that [any] year. |
|---|
| 90 | 88 | | SECTION 4. Section 102.256, Health and Safety Code, is |
|---|
| 91 | 89 | | amended by adding Subsections (c) and (d) to read as follows: |
|---|
| 92 | 90 | | (c) The oversight committee may transfer its management and |
|---|
| 93 | 91 | | disposition authority over the state's interest in securities, |
|---|
| 94 | 92 | | equities, royalties, income, and other benefits realized as a |
|---|
| 95 | 93 | | result of projects undertaken with money awarded under Subchapter E |
|---|
| 96 | 94 | | to the Texas Treasury Safekeeping Trust Company. If the oversight |
|---|
| 97 | 95 | | committee transfers management and disposition authority under |
|---|
| 98 | 96 | | this subsection, the trust company has any power necessary to |
|---|
| 99 | 97 | | accomplish the purposes of this section. |
|---|
| 100 | 98 | | (d) In managing the assets described by Subsection (c) |
|---|
| 101 | 99 | | through procedures and subject to restrictions that the Texas |
|---|
| 102 | 100 | | Treasury Safekeeping Trust Company considers appropriate, the |
|---|
| 103 | 101 | | trust company may acquire, exchange, sell, supervise, manage, or |
|---|
| 104 | 102 | | retain any kind of investment that a prudent investor, exercising |
|---|
| 105 | 103 | | reasonable care, skill, and caution, would acquire, exchange, sell, |
|---|
| 106 | 104 | | or retain in light of the purposes, terms, distribution |
|---|
| 107 | 105 | | requirements, and other circumstances then prevailing pertinent to |
|---|
| 108 | 106 | | each investment, including the requirements prescribed by |
|---|
| 109 | 107 | | Subsection (b) and the purposes described by Section 102.002. The |
|---|
| 110 | 108 | | trust company may charge a fee to recover the reasonable and |
|---|
| 111 | 109 | | necessary costs incurred in managing assets under this section. |
|---|
| 112 | 110 | | SECTION 5. Section 102.101(f), Health and Safety Code, is |
|---|
| 113 | 111 | | repealed. |
|---|
| 114 | 112 | | SECTION 6. This Act takes effect September 1, 2017. |
