97 relating to the operations of the Cancer Prevention and Research
108 Institute of Texas; authorizing a fee.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 572.003(c), Government Code, is amended
1311 to read as follows:
1412 (c) The term means a member of:
1513 (1) the Public Utility Commission of Texas;
1614 (2) the Texas Commission on Environmental Quality;

6967 SECTION 2. Section 102.107, Health and Safety Code, is
7068 amended to read as follows:
7169 Sec. 102.107. POWERS AND DUTIES. (a) The oversight
7270 committee shall:
7371 (1) hire a chief executive officer;
7472 (2) annually set priorities as prescribed by the
7573 legislature for each grant program that receives money under this
7674 chapter; and
7775 (3) consider the priorities set under Subdivision (2)
7876 in awarding grants under this chapter.
7977 (b) The oversight committee may conduct a closed meeting in
8078 accordance with Subchapter E, Chapter 551, Government Code, to
8179 discuss issues related to managing, acquiring, or selling
8280 securities or other revenue-sharing obligations realized under the
8381 standards established as required by Section 102.256.
8482 SECTION 3. Section 102.203(e), Health and Safety Code, is
8583 amended to read as follows:
8684 (e) Not more than 10 percent of the money appropriated by
8785 the legislature for grants in a state fiscal year [awarded under
8886 this subchapter] may be used for cancer prevention and control
8987 programs during that [any] year.
9088 SECTION 4. Section 102.256, Health and Safety Code, is
9189 amended by adding Subsections (c) and (d) to read as follows:
9290 (c) The oversight committee may transfer its management and
9391 disposition authority over the state's interest in securities,
9492 equities, royalties, income, and other benefits realized as a
9593 result of projects undertaken with money awarded under Subchapter E
9694 to the Texas Treasury Safekeeping Trust Company. If the oversight
9795 committee transfers management and disposition authority under
9896 this subsection, the trust company has any power necessary to
9997 accomplish the purposes of this section.
10098 (d) In managing the assets described by Subsection (c)
10199 through procedures and subject to restrictions that the Texas
102100 Treasury Safekeeping Trust Company considers appropriate, the
103101 trust company may acquire, exchange, sell, supervise, manage, or
104102 retain any kind of investment that a prudent investor, exercising
105103 reasonable care, skill, and caution, would acquire, exchange, sell,
106104 or retain in light of the purposes, terms, distribution
107105 requirements, and other circumstances then prevailing pertinent to
108106 each investment, including the requirements prescribed by
109107 Subsection (b) and the purposes described by Section 102.002. The
110108 trust company may charge a fee to recover the reasonable and
111109 necessary costs incurred in managing assets under this section.
112110 SECTION 5. Section 102.101(f), Health and Safety Code, is
113111 repealed.
114112 SECTION 6. This Act takes effect September 1, 2017.
