99 relating to certain reporting requirements for law enforcement
1010 agencies and to the creation of a criminal justice web portal by the
1111 office of the attorney general.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 2.139(e), Code of Criminal Procedure, as
1414 added by Chapter 516 (H.B. 1036), Acts of the 84th Legislature,
1515 Regular Session, 2015, is amended to read as follows:
1616 (e) Not later than March [February] 1 of each year, the
1717 office of the attorney general shall submit a report regarding all
1818 officer-involved injuries or deaths that occurred during the
1919 preceding year to the governor and the standing legislative
2020 committees with primary jurisdiction over criminal justice
2121 matters. The report must include:
2222 (1) the total number of officer-involved injuries or
2323 deaths;
2424 (2) a summary of the reports submitted to the office
2525 under this article; and
2626 (3) a copy of each report submitted to the office under
2727 this article.
2828 SECTION 2. Article 2.1395(c), Code of Criminal Procedure,
2929 is amended to read as follows:
3030 (c) Not later than March [February] 1 of each year, the
3131 office of the attorney general shall submit a report regarding all
3232 incidents described by Subsection (a) that occurred during the
3333 preceding year to the governor and the standing legislative
3434 committees with primary jurisdiction over criminal justice
3535 matters. The report must include:
3636 (1) the total number of incidents that occurred;
3737 (2) a summary of the reports submitted to the office
3838 under this article; and
3939 (3) a copy of each report submitted to the office under
4040 this article.
4141 SECTION 3. Subchapter B, Chapter 402, Government Code, is
4242 amended by adding Section 402.040 to read as follows:
4343 Sec. 402.040. CRIMINAL JUSTICE WEB PORTAL. (a) The office
4444 of the attorney general shall develop and maintain a web portal to
4545 collect, compile, and analyze data related to criminal justice in
4646 this state. The office shall ensure that the web portal is
4747 accessible through the state electronic Internet portal project.
4848 (b) The attorney general shall direct each law enforcement
4949 agency to submit through the web portal any report required to be
5050 submitted by the agency to the office of the attorney general under
5151 any law, including information reported under Article 2.139, Code
5252 of Criminal Procedure, as added by Chapter 516 (H.B. 1036), Acts of
5353 the 84th Legislature, Regular Session, 2015, and Article 2.1395,
5454 Code of Criminal Procedure, but excluding information reported
5555 under Chapter 56, Code of Criminal Procedure.
5656 (c) The web portal must:
5757 (1) provide access to reports submitted to the office
5858 of the attorney general through the web portal, other than reports
5959 that are confidential or protected from disclosure under state or
6060 federal law; and
6161 (2) include an interactive dashboard that provides an
6262 analysis and a visual representation of the data included in the
6363 reports described by Subdivision (1).
6464 (d) The reports and dashboard required by Subsection (c)
6565 must be accessible to the public.
6666 (e) In developing the web portal, the office of the attorney
6767 general may contract or consult with a nonprofit organization that
6868 specializes in web-based data analysis.
6969 SECTION 4. Not later than September 1, 2018, the office of
7070 the attorney general shall develop the web portal required under
7171 Section 402.040, Government Code, as added by this Act.
7272 SECTION 5. This Act takes effect September 1, 2017.
