108 relating to the use of home telemonitoring services under Medicaid.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 531.02164, Government Code, is amended
1311 by amending Subsection (c) and adding Subsections (c-1) and (c-2)
1412 to read as follows:
1513 (c) The program required under this section must:
1614 (1) provide that home telemonitoring services are
1715 available only to a person [persons] who:
1816 (A) is [are] diagnosed with one or more of the
1917 following conditions:
2018 (i) pregnancy;
2119 (ii) diabetes;
2220 (iii) heart disease;
2321 (iv) cancer;
2422 (v) chronic obstructive pulmonary disease;
2523 (vi) hypertension;
2624 (vii) congestive heart failure;
2725 (viii) mental illness or serious emotional
2826 disturbance;
2927 (ix) asthma;
3028 (x) myocardial infarction; or
3129 (xi) stroke; and
3230 (B) exhibits [exhibit] two or more of the
3331 following risk factors:
3432 (i) two or more hospitalizations in the
3533 prior 12-month period;
3634 (ii) frequent or recurrent emergency room
3735 admissions;
3836 (iii) a documented history of poor
3937 adherence to ordered medication regimens;
4038 (iv) a documented history of falls in the
4139 prior six-month period;
4240 (v) limited or absent informal support
4341 systems;
4442 (vi) living alone or being home alone for
4543 extended periods of time; and
4644 (vii) a documented history of care access
4745 challenges;
4846 (2) ensure that clinical information gathered by a
4947 home and community support services agency or hospital while
5048 providing home telemonitoring services is shared with the patient's
5149 physician; [and]
5250 (3) ensure that the program does not duplicate disease
5351 management program services provided under Section 32.057, Human
5452 Resources Code; and
5553 (4) provide reimbursement for home telemonitoring
5654 services in the event of an unsuccessful data transmission if the
5755 provider of the services attempts to communicate with the patient
5856 by telephone or in person to establish a successful data
5957 transmission.
6058 (c-1) Notwithstanding Subsection (c)(1), the program
6159 required under this section may also provide that home
6260 telemonitoring services are available to pediatric patients with
6361 chronic or complex medical needs who:
6462 (1) are being concurrently treated by at least three
6563 medical specialists;
6664 (2) are diagnosed with end-stage solid organ disease;
6765 (3) have received an organ transplant; or
6866 (4) are diagnosed with severe asthma.
6967 (c-2) A provider that is reimbursed under Subsection (c)(4)
7068 for home telemonitoring services provided to a patient may not also
7169 be reimbursed for communicating with the patient by telephone or in
7270 person to establish a successful data transmission as described by
7371 Subsection (c)(4).
7472 SECTION 2. As soon as practicable after the effective date
7573 of this Act, the executive commissioner of the Health and Human
7674 Services Commission shall adopt necessary rules to implement the
7775 changes in law made by this Act.
7876 SECTION 3. If before implementing any provision of this Act
7977 a state agency determines that a waiver or authorization from a
8078 federal agency is necessary for implementation of that provision,
8179 the agency affected by the provision shall request the waiver or
8280 authorization and may delay implementing that provision until the
8381 waiver or authorization is granted.
8482 SECTION 4. This Act takes effect September 1, 2017.
