| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 28.023, Education Code, is amended by |
|---|
| 15 | 9 | | adding Subsection (h) to read as follows: |
|---|
| 16 | 10 | | (h) This subsection applies only to a school district |
|---|
| 17 | 11 | | surrounded by a school district described by Section 11.065(a). |
|---|
| 18 | 12 | | Notwithstanding any other provision of this section, a school |
|---|
| 19 | 13 | | district's board of trustees may establish a minimum required score |
|---|
| 20 | 14 | | for each section of an examination for acceleration or an |
|---|
| 21 | 15 | | examination for credit approved by the board under Subsection (a) |
|---|
| 22 | 16 | | that is higher than the minimum required scores under Subsections |
|---|
| 23 | 17 | | (b) and (c), respectively. A minimum required score established by |
|---|
| 24 | 18 | | a board of trustees under this subsection: |
|---|
| 25 | 19 | | (1) may be no greater than a score in the 90th |
|---|
| 26 | 20 | | percentile; |
|---|
| 27 | 21 | | (2) must be established before the beginning of a |
|---|
| 28 | 22 | | school year for examinations to be administered in the school year; |
|---|
| 29 | 23 | | and |
|---|
| 30 | 24 | | (3) must apply for at least the entire school year. |
|---|
| 31 | 25 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 32 | 26 | | school year. |
|---|
| 33 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 31 | | Act takes effect September 1, 2017. |
