104 AN ACT
115 relating to minimum scores required for students in certain school
126 districts to pass an examination for acceleration or for credit.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 28.023, Education Code, is amended by
159 adding Subsection (h) to read as follows:
1610 (h) This subsection applies only to a school district
1711 surrounded by a school district described by Section 11.065(a).
1812 Notwithstanding any other provision of this section, a school
1913 district's board of trustees may establish a minimum required score
2014 for each section of an examination for acceleration or an
2115 examination for credit approved by the board under Subsection (a)
2216 that is higher than the minimum required scores under Subsections
2317 (b) and (c), respectively. A minimum required score established by
2418 a board of trustees under this subsection:
2519 (1) may be no greater than a score in the 90th
2620 percentile;
2721 (2) must be established before the beginning of a
2822 school year for examinations to be administered in the school year;
2923 and
3024 (3) must apply for at least the entire school year.
3125 SECTION 2. This Act applies beginning with the 2017-2018
3226 school year.
3327 SECTION 3. This Act takes effect immediately if it receives
3428 a vote of two-thirds of all the members elected to each house, as
3529 provided by Section 39, Article III, Texas Constitution. If this
3630 Act does not receive the vote necessary for immediate effect, this
3731 Act takes effect September 1, 2017.
