99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to standing in a roadway; amending provisions subject to a
1212 criminal penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Section 552.007, Transportation
1515 Code, is amended to read as follows:
1616 Sec. 552.007. [SOLICITATION BY] PEDESTRIANS IN ROADWAY.
1717 SECTION 2. Section 552.007(a), Transportation Code, is
1818 amended to read as follows:
1919 (a) A person may not stand in a roadway in a manner that
2020 impedes vehicular traffic or presents a danger to the person or
2121 another person unless [to solicit a ride, contribution, employment,
2222 or business from an occupant of a vehicle, except that a person may
2323 stand in a roadway to solicit a charitable contribution if]
2424 authorized to do so by the local authority having jurisdiction over
2525 the roadway.
2626 SECTION 3. Sections 552.006(b), 552.007(b) and (c), and
2727 552.0071, Transportation Code, are repealed.
2828 SECTION 4. The changes in law made by this Act apply only to
2929 an offense committed on or after the effective date of this Act. An
3030 offense committed before the effective date of this Act is governed
3131 by the law in effect on the date the offense was committed, and the
3232 former law is continued in effect for that purpose. For purposes of
3333 this section, an offense was committed before the effective date of
3434 this Act if any element of the offense occurred before that date.
3535 SECTION 5. This Act takes effect September 1, 2017.
