| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. The heading to Section 552.007, Transportation |
|---|
| 15 | 15 | | Code, is amended to read as follows: |
|---|
| 16 | 16 | | Sec. 552.007. [SOLICITATION BY] PEDESTRIANS IN ROADWAY. |

| 17 | 17 | | SECTION 2. Section 552.007(a), Transportation Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (a) A person may not stand in a roadway in a manner that |
|---|
| 20 | 20 | | impedes vehicular traffic or presents a danger to the person or |
|---|
| 21 | 21 | | another person unless [to solicit a ride, contribution, employment, |
|---|
| 22 | 22 | | or business from an occupant of a vehicle, except that a person may |
|---|
| 23 | 23 | | stand in a roadway to solicit a charitable contribution if] |
|---|
| 24 | 24 | | authorized to do so by the local authority having jurisdiction over |
|---|
| 25 | 25 | | the roadway. |

| 26 | 26 | | SECTION 3. Sections 552.006(b), 552.007(b) and (c), and |
|---|
| 27 | 27 | | 552.0071, Transportation Code, are repealed. |
|---|
| 28 | 28 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | an offense committed on or after the effective date of this Act. An |
|---|
| 30 | 30 | | offense committed before the effective date of this Act is governed |
|---|
| 31 | 31 | | by the law in effect on the date the offense was committed, and the |
|---|
| 32 | 32 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 33 | 33 | | this section, an offense was committed before the effective date of |
|---|
| 34 | 34 | | this Act if any element of the offense occurred before that date. |
|---|
| 35 | 35 | | SECTION 5. This Act takes effect September 1, 2017. |
