55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of a transportation allotment under the
88 foundation school program based on the price of gasoline.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.155, Education Code, is amended by
1111 amending Subsection (c) and adding Subsections (c-1) and (c-2) to
1212 read as follows:
1313 (c) Each district or county operating a regular
1414 transportation system is entitled to an allotment based on the
1515 daily cost per regular eligible student of operating and
1616 maintaining the regular transportation system and the linear
1717 density of that system. In determining the cost, the commissioner
1818 shall give consideration to factors affecting the actual cost of
1919 providing these transportation services in each district or county.
2020 The average actual cost is to be computed by the commissioner and
2121 included for consideration by the legislature in the General
2222 Appropriations Act.
2323 (c-1) The allotment per mile of approved route under
2424 Subsection (c) is the product of the average price of a gallon of
2525 regular gasoline in this state, including taxes, during the
2626 preceding five calendar years, as determined by the commissioner,
2727 and the following multiplier:

3838 (c-2) Subsection (c-1) applies beginning with the 2019-2020
3939 school year. For the 2017-2018 school year, the allotment per mile
4040 of approved route is 80 percent of the allotment that would be
4141 provided during that year under Subsection (c-1). For the 2018-2019
4242 school year, the allotment per mile of approved route is 90 percent
4343 of the allotment that would be provided during that year under
4444 Subsection (c-1). This subsection expires September 1, 2020.
4545 SECTION 2. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2017.
