| 7 | 7 | | relating to the provision of a transportation allotment under the |

| 8 | 8 | | foundation school program based on the price of gasoline. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.155, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (c) and adding Subsections (c-1) and (c-2) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) Each district or county operating a regular |
|---|
| 14 | 14 | | transportation system is entitled to an allotment based on the |
|---|
| 15 | 15 | | daily cost per regular eligible student of operating and |
|---|
| 16 | 16 | | maintaining the regular transportation system and the linear |
|---|
| 17 | 17 | | density of that system. In determining the cost, the commissioner |
|---|
| 18 | 18 | | shall give consideration to factors affecting the actual cost of |
|---|
| 19 | 19 | | providing these transportation services in each district or county. |
|---|
| 20 | 20 | | The average actual cost is to be computed by the commissioner and |
|---|
| 21 | 21 | | included for consideration by the legislature in the General |
|---|
| 22 | 22 | | Appropriations Act. |
|---|
| 23 | 23 | | (c-1) The allotment per mile of approved route under |
|---|
| 24 | 24 | | Subsection (c) is the product of the average price of a gallon of |
|---|
| 25 | 25 | | regular gasoline in this state, including taxes, during the |
|---|
| 26 | 26 | | preceding five calendar years, as determined by the commissioner, |
|---|
| 27 | 27 | | and the following multiplier: |

| 40 | 40 | | of approved route is 80 percent of the allotment that would be |

| 41 | 41 | | provided during that year under Subsection (c-1). For the 2018-2019 |

| 42 | 42 | | school year, the allotment per mile of approved route is 90 percent |
|---|
| 43 | 43 | | of the allotment that would be provided during that year under |
|---|
| 44 | 44 | | Subsection (c-1). This subsection expires September 1, 2020. |

| 45 | 45 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2017. |
