7	6		AN ACT
8	7		relating to emergency medical air transportation funding.
9	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	9		SECTION 1. Chapter 773, Health and Safety Code, is amended
11	10		by adding Subchapter I to read as follows:
12	11		SUBCHAPTER I. EMERGENCY MEDICAL AIR TRANSPORTATION FUNDING
13	12		Sec. 773.221. DEFINITIONS. In this subchapter:
14	13		(1) "Account" means the emergency medical air
15	14		transportation account created under Section 773.222.
16	15		(2) "Commission" means the Health and Human Services
17	16		Commission.
18	17		Sec. 773.222. EMERGENCY MEDICAL AIR TRANSPORTATION
19	18		ACCOUNT. (a) The emergency medical air transportation account is
20	19		established as a dedicated account in the general revenue fund. The
21	20		account is composed of:
22	21		(1) money deposited to the credit of the account under
23	22		Section 542.4031, Transportation Code; and
24	23		(2) notwithstanding Section 404.071, Government Code,
25	24		interest earned on the investment of money in the account and
26	25		depository interest allocable to the account.
27	26		(b) Money in the account may be appropriated only to the
28	27		department for the purposes described by Subsection (c).
29		-	(c) The commissioner ~~may~~:

30	29		(1) use the money appropriated from the account to
31	30		provide funding, in addition to funding available from other
32	31		sources, for emergency medical air transportation; and
33	32		(2) after consulting with the executive commissioner,
34	33		transfer the money appropriated from the account to the commission
35	34		to:
36	35		(A) provide reimbursements under the medical
37	36		assistance program under Chapter 32, Human Resources Code, to
38	37		providers of emergency medical air transportation services,
39	38		including reimbursement enhancements to the statewide dollar
40	39		amount rate used to reimburse designated air ambulance services
41	40		under the program; and
42	41		(B) maximize the receipt of federal funds under
43	42		the medical assistance program under Chapter 32, Human Resources
44	43		Code, to the extent possible.
45	44		SECTION 2. Section 542.4031(g), Transportation Code, is
46	45		amended to read as follows:
47	46		(g) Of the money received by the comptroller under this
48	47		section, the comptroller shall deposit:
49	48		(1) 50 [67] percent to the credit of the undedicated
50	49		portion of the general revenue fund; [and]
51	50		(2) 33 percent to the credit of the designated trauma
52	51		facility and emergency medical services account under Section
53	52		780.003, Health and Safety Code; and
54	53		(3) 17 percent to the credit of the emergency medical
55	54		air transportation account under Section 773.222, Health and Safety
56	55		Code.
57	56		SECTION 3. Section 542.4031(g), Transportation Code, as
58	57		amended by this Act, applies only to the distribution of revenue
59	58		collected on or after the effective date of this Act. The
60	59		distribution of revenue collected before the effective date of this
61	60		Act is governed by the law in effect at the time the revenue was
62	61		collected, and that law is continued in effect for the purpose of
63	62		the distribution of that revenue.
