87 relating to emergency medical air transportation funding.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Chapter 773, Health and Safety Code, is amended
1110 by adding Subchapter I to read as follows:
1211 SUBCHAPTER I. EMERGENCY MEDICAL AIR TRANSPORTATION FUNDING
1312 Sec. 773.221. DEFINITIONS. In this subchapter:
1413 (1) "Account" means the emergency medical air
1514 transportation account created under Section 773.222.
1615 (2) "Commission" means the Health and Human Services
1716 Commission.
1817 Sec. 773.222. EMERGENCY MEDICAL AIR TRANSPORTATION
1918 ACCOUNT. (a) The emergency medical air transportation account is
2019 established as a dedicated account in the general revenue fund. The
2120 account is composed of:
2221 (1) money deposited to the credit of the account under
2322 Section 542.4031, Transportation Code; and
2423 (2) notwithstanding Section 404.071, Government Code,
2524 interest earned on the investment of money in the account and
2625 depository interest allocable to the account.
2726 (b) Money in the account may be appropriated only to the
2827 department for the purposes described by Subsection (c).
29- (c) The commissioner may:
28+ (c) The commissioner shall:
3029 (1) use the money appropriated from the account to
3130 provide funding, in addition to funding available from other
3231 sources, for emergency medical air transportation; and
3332 (2) after consulting with the executive commissioner,
3433 transfer the money appropriated from the account to the commission
3534 to:
3635 (A) provide reimbursements under the medical
3736 assistance program under Chapter 32, Human Resources Code, to
3837 providers of emergency medical air transportation services,
3938 including reimbursement enhancements to the statewide dollar
4039 amount rate used to reimburse designated air ambulance services
4140 under the program; and
4241 (B) maximize the receipt of federal funds under
4342 the medical assistance program under Chapter 32, Human Resources
4443 Code, to the extent possible.
4544 SECTION 2. Section 542.4031(g), Transportation Code, is
4645 amended to read as follows:
4746 (g) Of the money received by the comptroller under this
4847 section, the comptroller shall deposit:
4948 (1) 50 [67] percent to the credit of the undedicated
5049 portion of the general revenue fund; [and]
5150 (2) 33 percent to the credit of the designated trauma
5251 facility and emergency medical services account under Section
5352 780.003, Health and Safety Code; and
5453 (3) 17 percent to the credit of the emergency medical
5554 air transportation account under Section 773.222, Health and Safety
5655 Code.
5756 SECTION 3. Section 542.4031(g), Transportation Code, as
5857 amended by this Act, applies only to the distribution of revenue
5958 collected on or after the effective date of this Act. The
6059 distribution of revenue collected before the effective date of this
6160 Act is governed by the law in effect at the time the revenue was
6261 collected, and that law is continued in effect for the purpose of
6362 the distribution of that revenue.
64- SECTION 4. This Act takes effect September 1, 2017.
