55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the Transgender Healthcare
88 Advisory Committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section:
1111 (1) "Advisory committee" means the Transgender
1212 Healthcare Advisory Committee.
1313 (2) "Executive commissioner" means the executive
1414 commissioner of the Health and Human Services Commission.
1515 (b) The Health and Human Services Commission shall
1616 establish the Transgender Healthcare Advisory Committee to develop
1717 and provide recommendations on:
1818 (1) the health care and insurance needs for persons
1919 who identify as transgender; and
2020 (2) the adverse health impacts for patients who do not
2121 meet traditional gender standards under the Healthcare Common
2222 Procedure Coding System adopted by the Centers for Medicare &
2323 Medicaid Services of the United States Department of Health and
2424 Human Services or the American Medical Association's Current
2525 Procedural Terminology codes.
2626 (c) The advisory committee is composed of 15 members
2727 appointed by the executive commissioner, unless otherwise
2828 provided, as follows:
2929 (1) two representatives from a statewide or regional
3030 lesbian, gay, bisexual, and transgender or gender-identity
3131 advocacy organization;
3232 (2) one physician with broad experience working with
3333 persons who identify as transgender;
3434 (3) one representative from a lesbian, gay, bisexual,
3535 and transgender or gender-identity resource center;
3636 (4) one representative from a statewide medical
3737 association;
3838 (5) one representative from a statewide physicians'
3939 association;
4040 (6) one representative from a statewide pediatric
4141 physicians' association;
4242 (7) one representative from a statewide insurance
4343 association;
4444 (8) one representative from the Health and Human
4545 Services Commission;
4646 (9) one representative from the Department of State
4747 Health Services;
4848 (10) one representative from the Department of Family
4949 and Protective Services;
5050 (11) one representative from the Texas Department of
5151 Insurance, appointed by the commissioner of insurance;
5252 (12) one representative from the Texas Department of
5353 Criminal Justice, appointed by the executive director of the
5454 department;
5555 (13) one representative from The University of Texas
5656 at Austin, Texas A&M University at College Station, or the
5757 University of Houston; and
5858 (14) one representative from The University of Texas
5959 Health Science Center at Houston or The Texas A&M University Health
6060 Science Center.
6161 (d) The executive commissioner shall appoint a member of the
6262 advisory committee to serve as presiding officer.
6363 (e) A vacancy on the advisory committee shall be filled in
6464 the same manner as the original appointment.
6565 (f) A member of the advisory committee may not receive
6666 compensation for service on the advisory committee, but is entitled
6767 to reimbursement for actual and necessary expenses incurred in
6868 performing advisory committee duties. The advisory committee may
6969 accept gifts, grants, and donations to pay for those expenses.
7070 (g) The advisory committee shall meet at least quarterly at
7171 the call of the presiding officer and at other times as determined
7272 by the presiding officer.
7373 (h) The advisory committee shall develop recommendations to
7474 address:
7575 (1) the health care and insurance needs for persons
7676 who identify as transgender;
7777 (2) adverse health impacts for patients who do not
7878 meet traditional gender standards under the Healthcare Common
7979 Procedure Coding System adopted by the Centers for Medicare &
8080 Medicaid Services of the United States Department of Health and
8181 Human Services or the American Medical Association's Current
8282 Procedural Terminology codes and continuing education for health
8383 care professionals addressing those impacts; and
8484 (3) the health care needs for inmates who identify as
8585 transgender in jails and prisons in this state.
8686 (i) The Health and Human Services Commission shall provide
8787 administrative support for the advisory committee using existing
8888 resources.
8989 (j) Not later than August 31, 2018, the advisory committee
9090 shall submit a final report to the governor, the lieutenant
9191 governor, the speaker of the house of representatives, and the
9292 executive commissioner with its findings and recommendations
9393 described by Subsection (h) of this section.
9494 (k) The advisory committee is abolished June 1, 2019.
9595 SECTION 2. Not later than December 1, 2017, the executive
9696 commissioner of the Health and Human Services Commission, the
9797 commissioner of insurance, and the executive director of the Texas
9898 Department of Criminal Justice shall appoint members to the
9999 Transgender Healthcare Advisory Committee established under this
100100 Act.
101101 SECTION 3. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2017.
