5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the use of individual graduation committees to satisfy
8	8	certain public high school graduation requirements.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 12.104(b-2), Education Code, is amended
11	11	to read as follows:
12	12	(b-2) An open-enrollment charter school is subject to the
13	13	requirement to establish an individual graduation committee under
14	14	Section 28.0258. [This subsection expires September 1, 2017.]
15	15	SECTION 2. Section 28.025(c-6), Education Code, is amended
16	16	to read as follows:
17	17	(c-6) Notwithstanding Subsection (c), a person may receive
18	18	a diploma if the person is eligible for a diploma under Section
19	19	28.0258. [This subsection expires September 1, 2017.]
20	20	SECTION 3. Section 28.0258(e), Education Code, is amended
21	21	to read as follows:
22	22	(e) To be eligible to graduate and receive a high school
23	23	diploma under this section, a student must successfully complete
24	24	the curriculum requirements required for high school graduation:
25	25	(1) identified by the State Board of Education under
26	26	Section 28.025(a); or
27	27	(2) as otherwise provided by the transition plan
28	28	adopted by the commissioner to implement and administer the
29	29	amendments made by Chapter 211 (H.B. 5), Acts of the 83rd
30	30	Legislature, Regular Session, 2013, replacing the minimum,
31	31	recommended, and advanced high school programs with the foundation
32	32	high school program [under Section 28.025(h)].
33	33	SECTION 4. Section 39.025(a-2), Education Code, as added by
34	34	Chapter 5 (S.B. 149), Acts of the 84th Legislature, Regular
35	35	Session, 2015, is amended to read as follows:
36	36	(a-2) Notwithstanding Subsection (a), a student who has
37	37	failed to perform satisfactorily on end-of-course assessment
38	38	instruments in the manner provided under this section may receive a
39	39	high school diploma if the student has qualified for graduation
40	40	under Section 28.0258. [This subsection expires September 1,
41	41	2017.]
42	42	SECTION 5. Section 39.025(a-3), Education Code, is amended
43	43	to read as follows:
44	44	(a-3) A student who, after retaking an end-of-course
45	45	assessment instrument for Algebra I or English II, has failed to
46	46	perform satisfactorily as required by Subsection (a), but who
47	47	receives a score of proficient on the Texas Success Initiative
48	48	(TSI) diagnostic assessment for the corresponding subject for which
49	49	the student failed to perform satisfactorily on the end-of-course
50	50	assessment instrument satisfies the requirement concerning the
51	51	Algebra I or English II end-of-course assessment, as applicable.
52	52	[This subsection expires September 1, 2017.]
53	53	SECTION 6. Sections 28.0258(l) and 28.0259(e), Education
54	54	Code, are repealed.
55	55	SECTION 7. This Act takes effect immediately if it receives
56	56	a vote of two-thirds of all the members elected to each house, as
57	57	provided by Section 39, Article III, Texas Constitution. If this
58	58	Act does not receive the vote necessary for immediate effect, this
59	59	Act takes effect September 1, 2017.
