11	4		AN ACT
12	5		relating to the powers of the TexAmericas Center.
13	6		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	7		SECTION 1. Section 3503.003(a), Special District Local Laws
15	8		Code, is amended to read as follows:
16	9		(a) The authority is created to:
17	10		(1) accept title on approval by, and in coordination
18	11		with, the governor to all or a portion of the property on, adjacent
19	12		to, or related to the property described by Section 3503.004 from
20	13		the United States;
21	14		(2) promote the location and development of new
22	15		businesses, industries, and commercial activities on or related to
23	16		the property;
24	17		(3) undertake a project the board considers necessary
25	18		or incidental to the industrial, commercial, or business
26	19		development, redevelopment, maintenance, and expansion of new or
27	20		existing businesses on and for the property described by Section
28	21		3503.004, including the acquisition, construction, operation,
29	22		maintenance, repair, rehabilitation, replacement, improvement,
30	23		extension, expansion, or enhancement of:
31	24		(A) roads, bridges, and rights-of-way;
32	25		(B) housing;
33	26		(C) property;
34	27		(D) police, fire, medical, cultural,
35	28		educational, and research services, equipment, institutions, and
36	29		resources;
37	30		(E) other community support services;
38	31		(F) flood control, water, wastewater treatment,
39	32		natural gas, electricity, solid waste disposal, steam generation,
40	33		communications, and all other utility facilities and services;
41	34		(G) other infrastructure improvements; and
42	35		(H) any other services or facilities acquired by
43	36		the authority from the United States;
44	37		(4) promote or support an active military base located
45	38		in the same county as the authority to prevent closure or
46	39		realignment of the base and attract new military missions to the
47	40		base; [and]
48	41		(5) exercise the powers granted to a conservation and
49	42		reclamation district under Section 59, Article XVI, Texas
50	43		Constitution; and
51	44		(6) promote regional economic development and job
52	45		creation inside the district's boundaries and outside of the
53	46		district's boundaries in Bowie County and adjacent counties.
54	47		SECTION 2. Subchapter C, Chapter 3503, Special District
55	48		Local Laws Code, is amended by adding Section 3503.112 to read as
56	49		follows:
57	50		Sec. 3503.112. NONPROFIT CORPORATIONS FOR SPECIAL
58	51		PROJECTS. (a) The authority may authorize by resolution the
59	52		creation of a nonprofit corporation under the Business
60	53		Organizations Code solely to undertake on behalf of the authority a
61	54		project described by Section 3503.003(a)(3).
62	55		(b) The board shall appoint the board of directors of each
63	56		nonprofit corporation created under this section. A board member
64	57		is not required to reside in the authority.
65	58		(c) A board member or employee of the authority may
66	59		simultaneously serve as a member of the board of directors of a
67	60		nonprofit corporation. A person serving as a board member of the
68	61		authority and of a nonprofit corporation created under this section
69	62		may participate in all votes relating to the business of the
70	63		authority or the corporation.
71	64		(d) The nonprofit corporation may not exercise the power of
72	65		eminent domain.
73	66		(e) A nonprofit corporation created under this section is
74	67		subject to Chapters 551 and 552, Government Code.
75	68		SECTION 3. This Act takes effect September 1, 2017.
