114 AN ACT
125 relating to the powers of the TexAmericas Center.
136 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
147 SECTION 1. Section 3503.003(a), Special District Local Laws
158 Code, is amended to read as follows:
169 (a) The authority is created to:
1710 (1) accept title on approval by, and in coordination
1811 with, the governor to all or a portion of the property on, adjacent
1912 to, or related to the property described by Section 3503.004 from
2013 the United States;
2114 (2) promote the location and development of new
2215 businesses, industries, and commercial activities on or related to
2316 the property;
2417 (3) undertake a project the board considers necessary
2518 or incidental to the industrial, commercial, or business
2619 development, redevelopment, maintenance, and expansion of new or
2720 existing businesses on and for the property described by Section
2821 3503.004, including the acquisition, construction, operation,
2922 maintenance, repair, rehabilitation, replacement, improvement,
3023 extension, expansion, or enhancement of:
3124 (A) roads, bridges, and rights-of-way;
3225 (B) housing;
3326 (C) property;
3427 (D) police, fire, medical, cultural,
3528 educational, and research services, equipment, institutions, and
3629 resources;
3730 (E) other community support services;
3831 (F) flood control, water, wastewater treatment,
3932 natural gas, electricity, solid waste disposal, steam generation,
4033 communications, and all other utility facilities and services;
4134 (G) other infrastructure improvements; and
4235 (H) any other services or facilities acquired by
4336 the authority from the United States;
4437 (4) promote or support an active military base located
4538 in the same county as the authority to prevent closure or
4639 realignment of the base and attract new military missions to the
4740 base; [and]
4841 (5) exercise the powers granted to a conservation and
4942 reclamation district under Section 59, Article XVI, Texas
5043 Constitution; and
5144 (6) promote regional economic development and job
5245 creation inside the district's boundaries and outside of the
5346 district's boundaries in Bowie County and adjacent counties.
5447 SECTION 2. Subchapter C, Chapter 3503, Special District
5548 Local Laws Code, is amended by adding Section 3503.112 to read as
5649 follows:
5750 Sec. 3503.112. NONPROFIT CORPORATIONS FOR SPECIAL
5851 PROJECTS. (a) The authority may authorize by resolution the
5952 creation of a nonprofit corporation under the Business
6053 Organizations Code solely to undertake on behalf of the authority a
6154 project described by Section 3503.003(a)(3).
6255 (b) The board shall appoint the board of directors of each
6356 nonprofit corporation created under this section. A board member
6457 is not required to reside in the authority.
6558 (c) A board member or employee of the authority may
6659 simultaneously serve as a member of the board of directors of a
6760 nonprofit corporation. A person serving as a board member of the
6861 authority and of a nonprofit corporation created under this section
6962 may participate in all votes relating to the business of the
7063 authority or the corporation.
7164 (d) The nonprofit corporation may not exercise the power of
7265 eminent domain.
7366 (e) A nonprofit corporation created under this section is
7467 subject to Chapters 551 and 552, Government Code.
7568 SECTION 3. This Act takes effect September 1, 2017.
