125 relating to the establishment of a state plan for Streptococcus
136 pneumoniae education and prevention.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
169 amended by adding Chapter 94A to read as follows:
1710 CHAPTER 94A. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE; EDUCATION
1811 AND PREVENTION PROGRAM
1912 Sec. 94A.001. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE. (a)
2013 The department, using existing resources and programs to the extent
2114 possible, shall develop a state plan for prevention and treatment
2215 of diseases caused by Streptococcus pneumoniae. The plan must
2316 include strategies for prevention and treatment of diseases caused
2417 by Streptococcus pneumoniae in specific demographic groups that are
2518 disproportionately affected by the diseases, including persons who
2619 are elderly, children under two years of age, persons living in
2720 long-term care facilities, persons with a chronic heart or lung
2821 disease, smokers, and persons with asplenia.
2922 (b) In developing the plan, the department shall seek the
3023 advice of:
3124 (1) the public, including members of the public who
3225 have been infected with Streptococcus pneumoniae;
3326 (2) each state agency that provides services to
3427 persons infected with Streptococcus pneumoniae or that is assigned
3528 duties related to diseases caused by Streptococcus pneumoniae,
3629 including any appropriate health and human services agency
3730 described by Section 531.001, Government Code, the Employees
3831 Retirement System of Texas, and the Teacher Retirement System of
3932 Texas;
4033 (3) any advisory body that addresses issues related to
4134 diseases caused by Streptococcus pneumoniae;
4235 (4) public advocates concerned with issues related to
4336 diseases caused by Streptococcus pneumoniae;
4437 (5) providers of services to persons with diseases
4538 caused by Streptococcus pneumoniae;
4639 (6) a statewide professional association of
4740 physicians; and
4841 (7) a statewide professional association of nurses.
4942 (c) The department shall review and modify as necessary the
5043 state plan developed under this section at least once every five
5144 years and may update the state plan biennially.
5245 Sec. 94A.002. STREPTOCOCCUS PNEUMONIAE EDUCATION AND
5346 PREVENTION PROGRAM. (a) The department shall develop a program to
5447 heighten awareness and enhance knowledge and understanding of
5548 Streptococcus pneumoniae.
5649 (b) The program developed under Subsection (a) must require
5750 the department to:
5851 (1) conduct health education, public awareness, and
5952 community outreach activities to promote public awareness and
6053 knowledge about the risk factors for, the value of early detection
6154 of, available screening services for, and the options available for
6255 the treatment of diseases caused by Streptococcus pneumoniae; and
6356 (2) post on the department's Internet website the
6457 options available for the prevention, treatment, and detection of
6558 diseases caused by Streptococcus pneumoniae and information on the
6659 risk factors for, method of transmission of, and value of early
6760 detection of the diseases.
6861 (c) The department, using existing resources, may include
6962 in the program developed under Subsection (a) a study to estimate
7063 the current and future impact on this state of diseases caused by
7164 Streptococcus pneumoniae.
7265 SECTION 2. This Act takes effect September 1, 2017.
