14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 8 | | SECTION 1. Subtitle D, Title 2, Health and Safety Code, is |
---|
16 | 9 | | amended by adding Chapter 94A to read as follows: |
---|
17 | 10 | | CHAPTER 94A. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE; EDUCATION |
---|
18 | 11 | | AND PREVENTION PROGRAM |
---|
19 | 12 | | Sec. 94A.001. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE. (a) |
---|
20 | 13 | | The department, using existing resources and programs to the extent |
---|
21 | 14 | | possible, shall develop a state plan for prevention and treatment |
---|
22 | 15 | | of diseases caused by Streptococcus pneumoniae. The plan must |
---|
23 | 16 | | include strategies for prevention and treatment of diseases caused |
---|
24 | 17 | | by Streptococcus pneumoniae in specific demographic groups that are |
---|
25 | 18 | | disproportionately affected by the diseases, including persons who |
---|
26 | 19 | | are elderly, children under two years of age, persons living in |
---|
27 | 20 | | long-term care facilities, persons with a chronic heart or lung |
---|
28 | 21 | | disease, smokers, and persons with asplenia. |
---|
29 | 22 | | (b) In developing the plan, the department shall seek the |
---|
30 | 23 | | advice of: |
---|
31 | 24 | | (1) the public, including members of the public who |
---|
32 | 25 | | have been infected with Streptococcus pneumoniae; |
---|
33 | 26 | | (2) each state agency that provides services to |
---|
34 | 27 | | persons infected with Streptococcus pneumoniae or that is assigned |
---|
35 | 28 | | duties related to diseases caused by Streptococcus pneumoniae, |
---|
36 | 29 | | including any appropriate health and human services agency |
---|
37 | 30 | | described by Section 531.001, Government Code, the Employees |
---|
38 | 31 | | Retirement System of Texas, and the Teacher Retirement System of |
---|
39 | 32 | | Texas; |
---|
40 | 33 | | (3) any advisory body that addresses issues related to |
---|
41 | 34 | | diseases caused by Streptococcus pneumoniae; |
---|
42 | 35 | | (4) public advocates concerned with issues related to |
---|
43 | 36 | | diseases caused by Streptococcus pneumoniae; |
---|
44 | 37 | | (5) providers of services to persons with diseases |
---|
45 | 38 | | caused by Streptococcus pneumoniae; |
---|
46 | 39 | | (6) a statewide professional association of |
---|
47 | 40 | | physicians; and |
---|
48 | 41 | | (7) a statewide professional association of nurses. |
---|
49 | 42 | | (c) The department shall review and modify as necessary the |
---|
50 | 43 | | state plan developed under this section at least once every five |
---|
51 | 44 | | years and may update the state plan biennially. |
---|
52 | 45 | | Sec. 94A.002. STREPTOCOCCUS PNEUMONIAE EDUCATION AND |
---|
53 | 46 | | PREVENTION PROGRAM. (a) The department shall develop a program to |
---|
54 | 47 | | heighten awareness and enhance knowledge and understanding of |
---|
55 | 48 | | Streptococcus pneumoniae. |
---|
56 | 49 | | (b) The program developed under Subsection (a) must require |
---|
57 | 50 | | the department to: |
---|
58 | 51 | | (1) conduct health education, public awareness, and |
---|
59 | 52 | | community outreach activities to promote public awareness and |
---|
60 | 53 | | knowledge about the risk factors for, the value of early detection |
---|
61 | 54 | | of, available screening services for, and the options available for |
---|
62 | 55 | | the treatment of diseases caused by Streptococcus pneumoniae; and |
---|
63 | 56 | | (2) post on the department's Internet website the |
---|
64 | 57 | | options available for the prevention, treatment, and detection of |
---|
65 | 58 | | diseases caused by Streptococcus pneumoniae and information on the |
---|
66 | 59 | | risk factors for, method of transmission of, and value of early |
---|
67 | 60 | | detection of the diseases. |
---|
68 | 61 | | (c) The department, using existing resources, may include |
---|
69 | 62 | | in the program developed under Subsection (a) a study to estimate |
---|
70 | 63 | | the current and future impact on this state of diseases caused by |
---|
71 | 64 | | Streptococcus pneumoniae. |
---|
72 | 65 | | SECTION 2. This Act takes effect September 1, 2017. |
---|
