66 AN ACT
77 relating to approval and recording requirements for certain
88 conveyances of land owned by political subdivisions to the United
99 States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 272, Local Government Code, is amended
1212 by adding Section 272.0001 to read as follows:
1313 Sec. 272.0001. GOVERNOR'S APPROVAL REQUIRED FOR CERTAIN
1414 CONVEYANCES OF LAND. (a) A political subdivision must provide the
1515 governor with advance notice of a proposed conveyance of land owned
1616 by the political subdivision to the United States. The notice must
1717 be sent to the governor not later than the 30th day before the date:
1818 (1) notice is published under Section 272.001; or
1919 (2) the land is offered for sale or exchange, if
2020 Section 272.001 is not applicable to the sale or exchange.
2121 (b) In addition to the advance notice of the proposed
2222 conveyance to the United States, the political subdivision shall
2323 submit to the governor a formal request for approval of the sale or
2424 exchange. The political subdivision may conduct the sale or
2525 exchange unless the governor gives the political subdivision
2626 written notice disapproving the sale or exchange. The governor
2727 must provide written notice of disapproval under this section not
2828 later than the 30th day after the date the governor receives the
2929 written request for approval.
3030 (c) This section does not apply to the sale or exchange of
3131 public land for use as a federal post office.
3232 SECTION 2. Chapter 272, Local Government Code, is amended
3333 by adding Section 272.007 to read as follows:
3434 Sec. 272.007. INFORMATION ABOUT CERTAIN CONVEYANCES OF LAND
3535 POSTED ON WEBSITE. (a) The General Land Office shall post
3636 information relating to the conveyance of any public land by a
3737 political subdivision to the United States, including land sold or
3838 exchanged for use as a federal post office, on the agency's Internet
3939 website. The information must be publicly accessible and include
4040 the following for each sale or exchange:
4141 (1) the entity acquiring the land;
4242 (2) the entity offering the land for sale or exchange;
4343 (3) the purchase price of the land or the value of the
4444 property for which the land was exchanged; and
4545 (4) the date of the sale or exchange.
4646 (b) A political subdivision shall provide the General Land
4747 Office the information described by Subsection (a) not later than
4848 the 30th day after the date the land is sold or exchanged.
4949 (c) The commissioner of the General Land Office shall adopt
5050 any rules necessary to implement this section.
5151 SECTION 3. The changes in law made by this Act do not apply
5252 to the sale or exchange of land for which:
5353 (1) notice of the offer of the sale or exchange is
5454 published under Section 272.001, Local Government Code, before the
5555 effective date of this Act; or
5656 (2) the offer of the sale or exchange is made before
5757 the effective date of this Act, if Section 272.001, Local
5858 Government Code, does not apply to the sale or exchange.
5959 SECTION 4. This Act takes effect September 1, 2017.
