| 7 | 7 | | relating to approval and recording requirements for certain |
|---|
| 8 | 8 | | conveyances of land owned by political subdivisions to the United |
|---|
| 9 | 9 | | States. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 272, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Section 272.0001 to read as follows: |
|---|
| 13 | 13 | | Sec. 272.0001. GOVERNOR'S APPROVAL REQUIRED FOR CERTAIN |
|---|
| 14 | 14 | | CONVEYANCES OF LAND. (a) A political subdivision must provide the |
|---|
| 15 | 15 | | governor with advance notice of a proposed conveyance of land owned |
|---|
| 16 | 16 | | by the political subdivision to the United States. The notice must |
|---|
| 17 | 17 | | be sent to the governor not later than the 30th day before the date: |
|---|
| 18 | 18 | | (1) notice is published under Section 272.001; or |
|---|
| 19 | 19 | | (2) the land is offered for sale or exchange, if |
|---|
| 20 | 20 | | Section 272.001 is not applicable to the sale or exchange. |
|---|
| 21 | 21 | | (b) In addition to the advance notice of the proposed |
|---|
| 22 | 22 | | conveyance to the United States, the political subdivision shall |
|---|
| 23 | 23 | | submit to the governor a formal request for approval of the sale or |
|---|
| 24 | 24 | | exchange. The political subdivision may conduct the sale or |
|---|
| 25 | 25 | | exchange unless the governor gives the political subdivision |
|---|
| 26 | 26 | | written notice disapproving the sale or exchange. The governor |
|---|
| 27 | 27 | | must provide written notice of disapproval under this section not |
|---|
| 28 | 28 | | later than the 30th day after the date the governor receives the |
|---|
| 29 | 29 | | written request for approval. |
|---|
| 30 | 30 | | (c) This section does not apply to the sale or exchange of |
|---|
| 31 | 31 | | public land for use as a federal post office. |
|---|
| 32 | 32 | | SECTION 2. Chapter 272, Local Government Code, is amended |
|---|
| 33 | 33 | | by adding Section 272.007 to read as follows: |
|---|
| 34 | 34 | | Sec. 272.007. INFORMATION ABOUT CERTAIN CONVEYANCES OF LAND |
|---|
| 35 | 35 | | POSTED ON WEBSITE. (a) The General Land Office shall post |
|---|
| 36 | 36 | | information relating to the conveyance of any public land by a |
|---|
| 37 | 37 | | political subdivision to the United States, including land sold or |
|---|
| 38 | 38 | | exchanged for use as a federal post office, on the agency's Internet |
|---|
| 39 | 39 | | website. The information must be publicly accessible and include |
|---|
| 40 | 40 | | the following for each sale or exchange: |
|---|
| 41 | 41 | | (1) the entity acquiring the land; |
|---|
| 42 | 42 | | (2) the entity offering the land for sale or exchange; |
|---|
| 43 | 43 | | (3) the purchase price of the land or the value of the |
|---|
| 44 | 44 | | property for which the land was exchanged; and |
|---|
| 45 | 45 | | (4) the date of the sale or exchange. |
|---|
| 46 | 46 | | (b) A political subdivision shall provide the General Land |
|---|
| 47 | 47 | | Office the information described by Subsection (a) not later than |
|---|
| 48 | 48 | | the 30th day after the date the land is sold or exchanged. |
|---|
| 49 | 49 | | (c) The commissioner of the General Land Office shall adopt |
|---|
| 50 | 50 | | any rules necessary to implement this section. |
|---|
| 51 | 51 | | SECTION 3. The changes in law made by this Act do not apply |
|---|
| 52 | 52 | | to the sale or exchange of land for which: |
|---|
| 53 | 53 | | (1) notice of the offer of the sale or exchange is |
|---|
| 54 | 54 | | published under Section 272.001, Local Government Code, before the |
|---|
| 55 | 55 | | effective date of this Act; or |
|---|
| 56 | 56 | | (2) the offer of the sale or exchange is made before |
|---|
| 57 | 57 | | the effective date of this Act, if Section 272.001, Local |
|---|
| 58 | 58 | | Government Code, does not apply to the sale or exchange. |
|---|
| 59 | 59 | | SECTION 4. This Act takes effect September 1, 2017. |
