55 A JOINT RESOLUTION
66 proposing a constitutional amendment prohibiting the taxation of
77 the sale or use of certain prescription medicine.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article VIII, Texas Constitution, is amended by
1010 adding Section 26 to read as follows:
1111 Sec. 26. The legislature may not enact a general law that
1212 would impose a state tax on the sale or use of a prescription
1313 medicine that was not subject to taxation under Chapter 151, Tax
1414 Code, on January 1, 2017.
1515 SECTION 2. The following temporary provision is added to
1616 the Texas Constitution:
1717 TEMPORARY PROVISION. (a) This temporary provision applies
1818 to the constitutional amendment proposed by the 85th Legislature,
1919 Regular Session, 2017, prohibiting the taxation of the sale or use
2020 of certain prescription medicine.
2121 (b) This temporary provision expires December 31, 2019.
2222 (c) If the 85th Legislature, during the regular or a special
2323 session, enacts a general law prohibited by Section 26, Article
2424 VIII, of this constitution, the portion of the general law that
2525 violates that section expires January 1, 2019.
2626 SECTION 3. This proposed constitutional amendment shall be
2727 submitted to the voters at an election to be held November 7, 2017.
2828 The ballot shall be printed to permit voting for or against the
2929 proposition: "The constitutional amendment prohibiting the
3030 taxation of the sale or use of certain prescription medicine."
