56 A JOINT RESOLUTION
67 proposing a constitutional amendment to restrict the power of the
78 legislature to mandate requirements on a municipality or county.
89 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
910 SECTION 1. Article III, Texas Constitution, is amended by
1011 adding Section 68 to read as follows:
1112 Sec. 68. A law enacted by the legislature on or after
1213 January 1, 2018, that requires a municipality or county to
1314 establish, expand, or modify a duty or activity that requires the
1415 expenditure of revenue by the municipality or county is not
1516 effective unless the legislature appropriates or otherwise
1617 provides, from a source other than the revenue of the municipality
1718 or county, for the payment or reimbursement of the costs incurred
1819 for the biennium by the municipality or county in complying with the
1920 requirement.
2021 SECTION 2. This proposed constitutional amendment shall be
2122 submitted to the voters at an election to be held November 7, 2017.
2223 The ballot shall be printed to permit voting for or against the
2324 proposition: "The constitutional amendment to restrict the power
2425 of the legislature from mandating unfunded requirements on a
2526 municipality or county."
