114 A BILL TO BE ENTITLED
125 AN ACT
136 relating to the licensing of family residential centers by the
147 Department of Family and Protective Services and the detention of
158 certain juveniles.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1811 is amended by adding Section 42.0538 to read as follows:
1912 Sec. 42.0538. FAMILY RESIDENTIAL CENTERS. (a) In this
2013 section, "family residential center" means a facility that:
2114 (1) is operated by or under a contract with United
2215 States Immigration and Customs Enforcement to enforce federal
2316 immigration laws;
2417 (2) houses children with a parent or other adult
2518 family member who remains with the child at the center or children
2619 who are not accompanied by a parent or other adult family member;
2720 and
2821 (3) provides care for children for at least part of a
2922 day.
3023 (b) Except as provided by Subsection (c), the department
3124 shall license a family residential center in the same manner as the
3225 department licenses a general residential operation under this
3326 chapter.
27+ (b-1) The department shall revoke the license of a family
28+ residential center if 90 percent or more of the people detained at
29+ the family residential center are held at the center for longer than
30+ 90 days.
3431 (c) The executive commissioner by rule may exempt a family
3532 residential center from any minimum standard or rule applicable to
3633 a general residential operation as the executive commissioner
3734 determines necessary to:
3835 (1) allow members of a family to remain together in the
3936 same living space;
4037 (2) allow a child's parent or other adult family member
4138 who is housed with the child to supervise and care for the child at
4239 the family residential center; or
4340 (3) operate the family residential center.
4441 (d) Subsection (c) does not prohibit the department from
4542 granting a waiver or variance on a case-by-case basis as authorized
4643 by other law.
4744 (e) This section does not waive sovereign immunity or create
4845 a cause of action.
4946 (f) This section expires September 1, 2019.
5047 SECTION 2. This Act takes effect immediately if it receives
5148 a vote of two-thirds of all the members elected to each house, as
5249 provided by Section 39, Article III, Texas Constitution. If this
5350 Act does not receive the vote necessary for immediate effect, this
5451 Act takes effect September 1, 2017.
