| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Subchapter D, Chapter 156, Tax Code, is amended |
|---|
| 11 | 9 | | by adding Section 156.155 to read as follows: |

| 12 | 10 | | Sec. 156.155. AVAILABILITY OF CERTAIN TAXPAYER |
|---|
| 13 | 11 | | INFORMATION. (a) A state agency may not post on a public Internet |
|---|
| 14 | 12 | | website information that identifies the taxable receipts of an |
|---|
| 15 | 13 | | individual business that is contained in or derived from a record, |
|---|
| 16 | 14 | | report, or other document required to be provided under this |
|---|
| 17 | 15 | | chapter. |
|---|
| 18 | 16 | | (b) Information described by Subsection (a) that is |
|---|
| 19 | 17 | | collected or maintained by a state agency is public information |
|---|
| 20 | 18 | | under Section 552.002, Government Code. A state agency shall |
|---|
| 21 | 19 | | provide access to the information in the manner provided by Chapter |
|---|
| 22 | 20 | | 552, Government Code, and the exceptions under Subchapter C of that |
|---|
| 23 | 21 | | chapter do not apply to the information. |
|---|
| 24 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 26 | | Act takes effect September 1, 2017. |
