1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the inspection of certain commercial motor vehicles
1414 that are not domiciled in this state.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 548.052, Transportation Code, is amended
1717 to read as follows:
1818 Sec. 548.052. VEHICLES NOT SUBJECT TO INSPECTION. This
1919 chapter does not apply to:
2020 (1) a trailer, semitrailer, pole trailer, or mobile
2121 home moving under or bearing a current factory-delivery license
2222 plate or current in-transit license plate;
2323 (2) a vehicle moving under or bearing a paper dealer
2424 in-transit tag, machinery license, disaster license, parade
2525 license, prorate tab, one-trip permit, vehicle temporary transit
2626 permit, antique license, custom vehicle license, street rod
2727 license, temporary 24-hour permit, or permit license;
2828 (3) a trailer, semitrailer, pole trailer, or mobile
2929 home having an actual gross weight or registered gross weight of
3030 4,500 pounds or less;
3131 (4) farm machinery, road-building equipment, a farm
3232 trailer, or a vehicle required to display a slow-moving-vehicle
3333 emblem under Section 547.703;
3434 (5) a former military vehicle, as defined by Section
3535 504.502;
3636 (6) a vehicle qualified for a tax exemption under
3737 Section 152.092, Tax Code; [or]
3838 (7) a vehicle for which a certificate of title has been
3939 issued but that is not required to be registered; or
4040 (8) a vehicle that:
4141 (A) is not domiciled in this state;
4242 (B) is registered:
4343 (i) under the International Registration
4444 Plan as authorized by Section 502.091; or
4545 (ii) as a token trailer under Section
4646 502.255, including for an extended period under Section 502.0023;
4747 and
4848 (C) has been issued a certificate of inspection
4949 in compliance with federal motor carrier safety regulations.
5050 SECTION 2. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2017.
