1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to establishing and funding a grant program for testing
1414 evidence collected in relation to sexual assaults or other sex
1515 offenses; authorizing voluntary contributions.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. Subchapter A, Chapter 521, Transportation Code,
1818 is amended by adding Section 521.012 to read as follows:
1919 Sec. 521.012. VOLUNTARY CONTRIBUTION FOR EVIDENCE TESTING
2020 GRANT PROGRAM. (a) When a person applies for an original or
2121 renewal driver's license or personal identification certificate
2222 under this chapter, the person may contribute $1 or more to the
2323 evidence testing grant program established under Section
2424 772.00715, Government Code.
2525 (b) The department shall:
2626 (1) include space on the first page of each
2727 application for an original or renewal driver's license or personal
2828 identification certificate that allows a person applying for an
2929 original or renewal driver's license or personal identification
3030 certificate to indicate the amount that the person is voluntarily
3131 contributing to the grant program; and
3232 (2) provide an opportunity for the person to
3333 contribute to the grant program during the application process for
3434 an original or renewal driver's license or personal identification
3535 certificate on the department's Internet website.
3636 (c) The department shall send any contribution made under
3737 this section to the comptroller for deposit to the credit of the
3838 evidence testing account established under Section 772.00716,
3939 Government Code, not later than the 14th day of each month. Before
4040 sending the money to the comptroller, the department may deduct
4141 money equal to the amount of reasonable expenses for administering
4242 this section.
4343 SECTION 2. Subchapter C, Chapter 522, Transportation Code,
4444 is amended by adding Section 522.0295 to read as follows:
4545 Sec. 522.0295. VOLUNTARY CONTRIBUTION FOR EVIDENCE TESTING
4646 GRANT PROGRAM. (a) When a person applies for an original or
4747 renewal commercial driver's license under this chapter, the person
4848 may contribute $1 or more to the evidence testing grant program
4949 established under Section 772.00715, Government Code.
5050 (b) The department shall:
5151 (1) include space on the first page of each
5252 application for an original or renewal commercial driver's license
5353 that allows a person applying for an original or renewal commercial
5454 driver's license to indicate the amount that the person is
5555 voluntarily contributing to the grant program; and
5656 (2) provide an opportunity for the person to
5757 contribute to the grant program during the application process for
5858 an original or renewal commercial driver's license on the
5959 department's Internet website.
6060 (c) The department shall send any contribution made under
6161 this section to the comptroller for deposit to the credit of the
6262 evidence testing account established under Section 772.00716,
6363 Government Code, not later than the 14th day of each month. Before
6464 sending the money to the comptroller, the department may deduct
6565 money equal to the amount of reasonable expenses for administering
6666 this section.
6767 SECTION 3. Subchapter A, Chapter 772, Government Code, is
6868 amended by adding Sections 772.00715 and 772.00716 to read as
6969 follows:
7070 Sec. 772.00715. EVIDENCE TESTING GRANT PROGRAM. (a) In
7171 this section:
7272 (1) "Accredited crime laboratory" has the meaning
7373 assigned by Section 420.003.
7474 (2) "Criminal justice division" means the criminal
7575 justice division established under Section 772.006.
7676 (3) "Grant program" means the evidence testing grant
7777 program established under this section.
7878 (4) "Law enforcement agency" means:
7979 (A) the police department of a municipality;
8080 (B) the sheriff's office of a county; or
8181 (C) a constable's office of a county.
8282 (b) The criminal justice division shall establish and
8383 administer a grant program and shall disburse funds to assist law
8484 enforcement agencies or counties in testing evidence collected in
8585 relation to a sexual assault or other sex offense.
8686 (c) Grant funds may be used only for the testing by an
8787 accredited crime laboratory of evidence that was collected in
8888 relation to a sexual assault or other sex offense.
8989 (d) The criminal justice division:
9090 (1) may establish additional eligibility criteria for
9191 grant applicants; and
9292 (2) shall establish:
9393 (A) grant application procedures;
9494 (B) guidelines relating to grant amounts; and
9595 (C) criteria for evaluating grant applications.
9696 (e) The criminal justice division shall include in the
9797 biennial report required by Section 772.006(a)(9) detailed
9898 reporting of the results and performance of the grant program.
9999 (f) The criminal justice division may use any revenue
100100 available to the division to fund the grant program.
101101 Sec. 772.00716. EVIDENCE TESTING ACCOUNT. (a) The
102102 evidence testing account is created as a dedicated account in the
103103 general revenue fund of the state treasury.
104104 (b) Money in the account may be appropriated only to the
105105 criminal justice division established under Section 772.006 for
106106 purposes of the evidence testing grant program established under
107107 Section 772.00715.
108108 (c) Funds distributed under Section 772.00715 are subject
109109 to audit by the comptroller.
110110 SECTION 4. The changes in law made by this Act apply only to
111111 a person who applies for an original or renewal driver's license,
112112 commercial driver's license, or personal identification
113113 certificate on or after January 1, 2018.
114114 SECTION 5. This Act takes effect September 1, 2017.
